My partner and I have been living in the UK I am Canadian and we have relocated over here and had our first child.

We are trying to tackle the permanent Residency application within Canada.

My question is if I sponsor him do I have to provide an income/bank statements being his wife - on the application it seems as if this only needs to be included for unmarried comminlaw partners? Also can there be a co-sponsor ie. my mother, father ect.

Also if he is on a vistor visa at the moment this must be extended in order to legalize his stay in canada while the residency application is being assessed?

Thanks to anyone who can help this is sure a maze to tackle on your own!

First of all there are no co-signers necessary for a spousal, common-law or dependent child sponsorship application. These are minimum income exempt. This information is right in the application paperwork, in the sponsor's guide under "Who can Sponsor?"

Secondly, if he is in Canada now as a visitor, he will need to apply to extend his status before his current status expires if he wants to stay legally. How you do that depends on whether you are filing an inland sponsorship application, or an outland sponsorship application (which you can do even while he is staying with you in Canada, especially because he is from a visa-exempt country). If you file inland, include the extension application IN THE SAME ENVELOPE with the inland ap. You pay the additional fee either to extend as a visitor ($75), or you mark the box "Initial Work Permit" and include a $150 fee and he will be issued an open work permit when his case reaches first stage approval, or Approval in Principle (6-7 months after they receive the application). In doing this, as long as you file everything BEFORE his current status expires, he'll have implied status to remain in Canada until his case gets to AIP. Inland aps are taking 6-7 months right now to get to AIP, and then another 6-12 months to finalize.

If you file outland, he will still need to file an extension application to keep his status current until he receives PR approval - however, he's not able to extend to anything other than a visitor. He will file the same extension application, but separately from the PR ap. He'll need to include proof of your marriage, and that a PR ap is (or soon will be) in process. He'll also need to include proof of funds to support him - copies of your paycheque stubs or your letter of employment (that you'll also file with the PR ap) are good proofs. The application still needs to be received at CIC BEFORE his current status expires - and you should track the mailing and get proof of delivery so that you can demonstrate that he has "implied status" to remain in Canada until you receive word on the status of the extension. Being he's from the UK, his outland ap will be processed through London - they're currently finalizing spousal PR aps in 4-10 months total.
