Which visa should i apply if my husband is in canada studying?

My husband is in Canada and I am in India, which visa should I apply for?
1) Dependent spouse visa or tourist visa?
2) If at all I applied for a tourist Visa, could we change that to an Open Work Permit from (within) Canada?
3) Should I apply for work permit here in India or after I go to Canada?
4) To do all the above do I need to hire a Lawyer?
5) Does a dependent visa needs to be filed ONLY after 6 months of study is over(This is what most of the forums/ people are saying) how far this is true?
6) I am in IT industry for the past 4 years and i intend to move to edmonton, canada. Are there any chances that i get a job in canada?

Your reply eagerly awaited, My husband got his study permit in July and landed in 22nd August 2012.

You have to understand the difference between VISA and PERMIT. Visa allows you to enter a country. Permit gives permission to carry on a certain activity in the country you entered. For instance WORKING is an activity for which you will need a WORK PERMIT. But you can only work after you enter the country which is why you will need a visa.

In your case you will apply for a DEPENDENT SPOUSE OPEN PERMIT. When you apply, they will charge you for the TRV or the temporary resident visa and an OPEN WORK PERMIT with the dependent spouse clause added to the OPEN WORK PERMIT. This means, you will be allowed to enter Canada as the spouse of a student who is already in the country and also you will be allowed to work wherever and whichever company you want to with the OPEN Work permit.

If you are not sure about the application processes, you should def hire a lawyer. But a good one. Yes you should apply after 6 months off your husband being in Canada as a student. Ideally you should ahvee applied together along with your husband when he was applying for the student visa. However, its okay. You can apply after 6 months of him being in Canada as well. Actually your husband can approach a lawyer over here, who can prepare the application for you and can send the application back to you in India. Not sure if you have good lawyers in India for immigration. Once you get the application package send by the lawyer in Canada, you just have to go to the consulate or the VFS office in India and apply. Please see if this option is better or if hiring a lawyer in India is better. Try and get accustomed to the application forms. Once you get comfortable with the forms, its just a matter of filling it and providing the right supporting docs. You dont need a lawyer for that. Its your choice.

The Economy in the west is booming and if you know how to present yourself in a confident and professional manner and if you can prove that you know what you are talking about, you will def get a job out west. All the best!

I have same condition here but little bit different, I am from Nepal and my wife is in Canada in study permit, she went there in august 2012.
At that time i had applied for visitor visa but my visa was rejected by giving 3 reasons

1. purpose of visit
2. Your personal Assets and financial status.
3. i am not satisfied that you have sufficient funds including income or assets to carry out your stated purpose in going Canada.

At that time i didn't reapply but now i want apply again so what should i do to get visa this time.

I am permanent job holder in a renounce bank here having personal assets too so please help ............

Hi,

Your situation is similar to the one I replied to. Your visa was most probably refused becoz you seem to be a sure fit candidate for the SPOUSAL OPEN WORK PERMIT. Although, I have to admit I am not certain if that is the only issue why your visa was denied. However, you can reapply in a similar manner that of the above case to which I replied to.
