Which path should I go? LMO / PNP / CEC?

Hi there,

I am working under NOC 1123 with a working holiday visa in Vancouver, I have been working full time in the same job since May.

My work permit will expire end of April 2014, and my boss is happy to keep me as long as I can. After doing some research, I know there are three ways to extend my stay:

1. LMO+Work permit
Possible hurdle: difficult to get LMO since my job is not something irreplaceable?

2. BC PNP
Possible hurdle: same as LMO, since employer has to show efforts in looking for locals

3. CEC
Possible hurdle: 1 year full time experience needed, when my visa expires I will have worked 11.5 months in the company. But since 30 hrs per week means full time employment, while I am actually working 40 hours a week, can I apply CEC once I have reached the hours needed?

Which path works the best for me? Can I do all of them?

You can do all of them if you want to and if you qualify. 1. is not a permanent solution because you can only renew a work permit so many times. If you want to stay in Canada for good, you need PR.

Have you looked into if BC PNP will require an LMO for your employer to sponsor you? You should contact the PNP and find out what is needed. If an LMO is not required and you are able to get your PNP nomination before your work permit expires, you can apply for a new work permit without needing an LMO. You can ask the PNP about that option.

As for CEC, you might as well ask if you can apply after 6 months if you worked 60 hr. weeks but the answer is no, you need a full 12 months.

Have you looked into if you can get another year of working holiday? If the program allows you to apply twice, you may be able to apply for it again at the end of the year or beginning of 2014. You could then leave when the old one expires and flagpole to come back to activate the 2nd year and continue your job. Many countries allow you to apply twice and in some cases, the one year is an open working holiday and the 2nd option is a closed, tied to employer. You should look into that.

Unfortunately a second year of working holiday is not available in my country. And I now know CEC is not possible unless I get a LMO to extend my work permit, so that I can work a full 12 months.

BC PNP does not require an LMO for my employer to sponsor me, but it requires "the employer has actively recruited locally to fill the position" and "Businesses located within the Metro Vancouver area must have at least five permanent, full-time employees (or full-time equivalents) in BC at the time the application is made to the BC PNP", one coworker left last month, and we have only 4 employees left in office (including me), so the situation is kind of complicated.

Therefore, the only way left is LMO+Work Permit, but NOC 1123 is a rather common job position that it's difficult to get a neutral / positive LMO?

im currently working as a demolition foreman for a company since almost to years.
i can apply for cec or i can get another work permit thus i need a LMO, waht do
you think, is 7302 Noc code gonna get me a positiv LMO? i have an income of 15 bucks
an hour. my employer, i asked him to do that for me he sayd: we wont qualefy.. whats the
deal?? how can i convince him.

Go ahead and apply under CEC if you qualify.

When is your work permit expiring? If you get AOR from CEC before your work permit expires, you can apply for an open bridging work permit.

23 august this year

the ting is a close work permit i can go to school to and pay like canadians. in may
i coukd go to centenial they accepted me.
you know and idont wanna waste my time with working i wanna do the advanced
diploma.

is a netural LMO fine too.

As far as I know, you can not study in Canada unless you apply for a study permit, see http://www.cic.gc.ca/english/information/applications/guides/5269ETOC.asp#5269E2

Even if you want to continue on a closed work permit, you need an LMO.
