If an applicant who is legally working in USA and his status is C08 work permit. C08 work permit is issued to asylum applicant in USA and It means the individual is authorized to work in the United States based upon a pending asylum application. The question is whether he is eligible to apply for Canadian Permanent Resident legally from USA (As he holds a valid and legal C08 work permit from USA) or he has to go back to his home country to apply for Canadian Permanent Residence? Thanks for your help!

Yes, he can apply for Canadian permanent residence from the US if he qualifies.

I have to say, it's really sad opening these threads and seeing asylum seekers start to get picky about which countries they want to go to. If someone is being given asylum in the US and then wants PR in Canada, you have to ask, are they actually a genuine refugee? So its very disturbing to read that someone is lovingly being cared for by the US government by virtue of the issuance of a work permit, but then decides they want to go to Canada. Sounds depraved to me - and then they also want to go back to their home country? What? Asylum seekers are generally fleeing persecution, but this person sounds like they're the king and just want to be able to travel everywhere and pick and choose if they live in the US or Canada. Sounds like they just want whoever is going to give them a passport the quickest.

Well, that's life. You can spend your time dwelling on something you have no control over or be grateful they are looking at legal options to immigrate. Really, it has zero effect on you personally.
