When to file Mamandus

Hi all,
Just wanted to know when can i file Mamandus.
Sent: May 2015
Jan 6 2016: Test (passed and Full RQ)
Since then no update

ATIP says: Due date is Feb 2017 for my file.

Sent email to them, they said my file is in queue for residency hearing with a Judge. ATIP says that too.

I would like to know when can i file Mamandus as the processing time is 12months and it has been 18 already.

The 12 month are for routine applications. I do believe once you receive a RQ and need to see a judge your application turns into a non routine application and the 12 month processing time does not apply anymore.

I think I read somewhere of a person who had a similar case as yours and filed a Mandamus and they processed the case. This routine versus non routine is normally just an excuse for their ineptitude and utter incompetence. All that they have to do is appoint more judges to finish these files. Unfortunately, with regard to anything with this government, its all blah blah.

If you file a Mandamus, your file will definitely move. I think if it goes beyond Feb 2017, definitely file a Mandamus. This department was supposed to finish all files under the previous rules by April 2016, that became Dec 2016 and now, its whenever someone files a Mandamus. So much for 3 out of 4 years :(. Now you have essentially stayed possible 6 years or so to get your citizenship.

On a lighter side, "Like Trump says, if HRC and co. sent each other 650,000 emails, what work are they doing and no wonder nothing gets done". Its absolutely terrible on the way these guys are running this department. I think a big reason is because none of them have actually worked in the private sector though John McCallum did work for RBC but then again, RBC was outsourcing jobs but the sheer waste of time and resources by this department is mind boggling. This govt will jump to action when their poll numbers go down for them. Unfortunately, its still way too high. Remember how Trudeau started releasing all his so called plans in June 2015 when his poll numbers were going down. Unfortunately for everyone else, the NDP government in waiting was spineless and promised a balanced budget and the rest is history.

First of all did you have many absences? While you were in canada did you work all the time/study or you were not doing both? Last do you belong to any of the south asian/south east asian/middle east african or south american countries? Lastly did you get in touch with your MP and go see him personally and discuss with him your situation.

It is important to know that people that belong to certain countries are scrutinized more. In addition to that too many absences and while in canada if you are doing nothing, raises a red flag.You need push this, send webforms,see the MP try to speak with someone at the immigration ministers office. MANDAMUS is the last resort. Do tell me if you had an unusual case so we can discuss further accordingly. Refer to this link, someone posted a detailed case in regards to their situation and how a mandamus helped.

It seems you applied with old 3/4 rule just before the 4/6 rules came into force. If residency is a concern, It can have a huge impact on as to when you would have actually qualified for CIT. All the very best and there might be even a shortage of citizenship judges.
