Hello

I have posted a few times on here as me and my Canadian girlfriend where very unsure on what option to take.

We have since decided that the best option is marriage.

So I plan on taking a two week holiday in December in which we in this time will get married. We are still unsure in what the process is and have many concerns. She has recently been accepted by the courts in the UK to move back to Canada with her daughter. She is a permant resident herself along with her brother, sister and mother. So I really want to be with her and we have found that if we marry she could sponsor me to move over there. We were apart for 6 months from march this year until august were we have now dealt with the issuses we had in our own lives and are now focused on our future together.

So if we are to marry in Canada within my two week holiday can I go back and fourth from UK to Canada while the application is processing?

What actions does she need to take regarding the application ie does she begin the application and then its passed to me or do we both apply and state she is sponsoring me and im getting sponsored by her just on the CIC website its quite confusing as it shows ways for people to sponsor there spouse but doesn't show what application I should fill in so im a bit baffled by it all.

If your girlfriend is a PR of Canada, even after she becomes your wife, she must meet her RO in order to sponsor you.

it means, if she is a PR herself, and she is sponsoring you, she can not live outside of canada while the application is processing. she can leave on short trips only. you can travel back and forth as a visa exempt visitor while your application is processing.

First you say she is a Canadian and then you say she is a PR. There is a big difference. If she is a Canadian, she would have no problem sponsoring you as long as she isn't on welfare or in active bankruptcy. If she is a PR, like Alurra said, she must be residing in Canada and she must meet the RO.

The RO is having spent at least 730 days in Canada in the past 5 years or if she hasn't been a PR for 5 years yet, that she still has time to spend 730 days in her first 5 years.

If you are a UK citizen, there is no point in you applying inland. You should apply outland. Outland means that you pick the application form for spouse living outside Canada. That doesn't mean you can't be visiting though. You can visit for up to 6 months at a time or even apply to extend without a problem but you are also free to leave and go back to the UK any time.
