Whats the procedure for PR renewal and subsequent citizenship application

We (my kid, husband & I) did our landing in August 2013. We are Indian citizens and currently based in Dubai. Due to circumstances, we returned to Dubai after the landing and haven’t gone back since. The way situations are panning out, it seems like only my kid & I will be able to emigrate while my husband stays behind in Dubai. My questions are:
- I understand that if I go now, I will have to renew my PR after a few years and then apply for citizenship. How will the procedure work?
- Approximately how long before my son & I get citizenship?
- I understand that my husband will lose his PR if he doesn’t join us. Will this affect citizenship chances for me and my son since it was a joint application?
- If the need arises, will I be able to sponsor my husband in the next couple of years even though I’ll still be on the PR?

You need to return before August 2016, since after that time you will be in violation of the residency obligation.

You will need to renew your PR card when it expires, I believe you can apply up to 9 months before the expiry date. PR card renewals take a long time to process (like 6 months or so).

- Approximately how long before my son & I get citizenship?
You won't be eligible to apply for Canadian citizenship until you've spent 4 of 6 years residing in Canada. So you have a long way to go.

No it won't affect you at all.


- If the need arises, will I be able to sponsor my husband in the next couple of years even though I’ll still be on the PR?
Yes if he doesn't meet the RO and has his PR revoked or renounces it, you can sponsor him again for PR. If you are a PR yourself, you will need to stay residing in Canada during the process.

Also, does it make a difference to future sponsorship whether my husband renounces his PR and completes necessary paperwork versus his PR just getting revoked since he doesnt enter Canda within the stipulated time?

RO stands for residency obligation.

Keep in mind that if you stay outside Canada the maximum time or until August 2016, you may not leave again for the next 2 years or otherwise you will be unable to meet the RO of 2/5 years.

Also keep in mind that when you apply to renew your PR card, if you do not yet have 2/5 years in Canada, immigration may be slow in processing your application because they may want to see if you actually fulfill your 2/5 years and not just get a new PR card and then leave before you have it.

As far as I know, it does not matter whether your husband renounces his PR based on not meeting the RO or whether he loses it because he gets reported for not meeting it. He can still be sponsored.

He can visit you in Canada as long as his PR card is valid and he still has it. He should always answer questions from immigration officers truthfully. At some point, it may happen that he gets reported on entry based on not meeting the RO. If that happens, he may be given the choice of renouncing his PR on the spot or he could do nothing and let the report take place and lose his PR or he could appeal which is pointless in his case because he is staying outside Canada for work. After his loss of PR, he can apply for a visit visa and you can sponsor him for PR again. However, keep in mind that sponsorship is costly and takes a long time and if your husband is not about to become ready to settle in Canada in the next few years afterwards, his new PR will end up like his old one, that is he will not meet the RO again and eventually lose it.
