I am married but we are separated de facto for more than 4 years. I do not have legal papers for separation. Our annulment case was dismissed just this year for he didn't have money to push through with the case. In Philippines, annulment is really costly and takes forever to have the decision. Right now, I do not know his whereabouts and we are living with our own lives now.

How am I going to fill the IMM008 for these questions:

Have you previously married or in a common-law relationship? Y / N
( I am confused whether to fill this up or not because I am previously married with my ex-husband because I think it is just the same and already filled up that info in Question no. 13 Your current marital status)

c) Type of relationship
(should it be Married if I started to answer Question no. 8. I cannot say I am legally separated because I dont have the legal papers for that.)

From To (Should I fill the FROM with our date of marriage and TO with the date we ended up our relationship or just put the date today because we are still technically married).

Please advise. Thanks in advance.

AFAIK, Canada doesn't have a "legal separation" that requires paperwork. So, if you are living apart from your spouse and no longer in a conjugal relationship, this is considered separated.

But, if you want to file for divorce in Canada, I believe you must be separated for at least 1 year.

For CIC purposes, I think you are still married but separated.

As for the previously married or common-law question, that would depend on if you were married or common-law before your current marriage, or before your current common-law relationship. If you are applying as common-law spousal stream while still married then what you put might differ.

i just put married but i attached an explanation letter with regards to our marital status. because technically, we are married but living separately.
but in addtl fmily info form i put "separated" beside his name so it will be emphasized that we are separated.
