WHAT SHOULD I DO?

HI,
mY mother is in Canada she got confused with her situation there right now..before her work permit expired my mother apply an NBI clearance to the Philippine consulate because it is needed in her renewal of working permit,the problem is when it is released the Surname is wrong spelling thats why she need to mail it again to the philippines to correct the Spelling of her NBI and it takes one month in courier before we received it and 1 month to send her back,then when she start to apply work permit again she is waiting for the response coming from the immigration for one month i think ,so she has no working permit for more than 3 months already in total that time then her visa was denied because of delayed application ,she told it to her employer immediately then her employer send a supporting letter for my moms application then they wait for the result and it cause for another delay,now my mom is six months no woking permit ,then when the employer of my mom get the answer from the immigration they told them to apply for another LMO ,is it possible for my mom to wait her LMO and WORK PERMIT there in Canada since she was already there?because she really want to stay in canada and she was worried about her situation...anyone can help us?pls.pls...

Before her last work permit expired, did you mother apply to change her status to visitor? If she did not change her status to visitor before her last work permit expired, then it is not possible for her to get the work permit in Canada. She must leave Canada and return to the Philippines and apply from there.

If your mother has been without a valid work permit for six months, it's too late to fix the situation in Canada. She will need to return home and apply from there.

OH ,so sad :( my mom says she suppose to pay her restoration penalty but her employer says wait for the answer of the immigration first even shes willing to pay...and the processing in the phillippines is 8 mos.onwards...:(

Restoration only works if your mother is still within 90 days of her work permit expiring. So I don't see how restoration will work for your mother and I believe her only choice is to return home.

Sadly she is in Canada illegally , When she leaves the country she will most likely not be admitted back.
