What other options do I have left?

Hello,

My name is Ryan. I currently live in the United States. My boyfriend (Canadian citizen) and I have been in a steady relationship now for over three years. During the first year, he made two trips to me to visit. Last year I did the same to visit him in Canada. This year, I focused on finishing my ASA degree here in the US and applied for the University of Lethbridge in Lethbridge, AB. That was our plan all along. I would get done with school here and then I could get a study permit to come there.

Unfortunately, I have run into a snag along the way. The University no longer accepts Title IV loans from the United States government, and I am unable to provide the full cost of tuition ($15,000 CAD.) Needless to say, my study permit would be denied without proof of these funds.

Now, what options am I left with to come to Canada? I have been looking at a TRV (provided with a letter of invitation and all other required documentation.) I am going to apply for the TRV online through the CIC website and I was curious as to how long the processing time would be? (I need to include my intended length of stay and would not know without knowing how long it would be before I would receive my actual TRV.)

After receiving my TRV would it be at all possible to be married in Canada? We have discussed taking our relationship to the next level, but wanted to wait until I was actually in Canada. What would I need? SIN? etc.? And would I be able to obtain everything necessary while on a TRV?

Would it be possible to find an employer to sponsor a work permit while I am on a TRV inside of Canada?

Please understand, I have done all of the necessary research that is required and I am not going into this blindly. I just need answers to these questions.

I just found out that I can not APPLY for a TRV online since I do not NEED a TRV to come to Canada. What a shame. Now, remove the questions about the TRV and apply the same information. What can I do? What are my options up to this point?

I do not have much experience with student permits but obviously you are correct that they will not grant you a student permit without funds to pay for the tuition as well as money for living expenses in your account.

But I do have experience on the other stuff.

First of all what is your status in the US?
As far As I know they give a TRV valid from 3-6 months and then you have an option to extend it 30 days before it expires
The processing time is different depending on which office you send you application to. That is all available in the CIC check processing time website.

Yes it is possible to get married in Canada.
You have to go to a registry with your bf and get a marriage license TOGETHER. They usually ask for birth certificate and you must be able to provide both your parent's name and where they were born. once you have the MARRIAGE license the registry agent will give you a list of licensed marriage commissioner and you will contact them to get an appointment to get married (with fees of course) every commissioner has their own fee they charge, THey usually meet up with you before the actual day to see how you would like the wedding day to be. (private, grand and you can even elope.lol) as long as there is one witness for each of you. so you need 2 witnesses.

If you are only a visitor, you CANNOT get an SIN. (do not need SIN to get married)

IF you are patient and keep looking and not picky about the job you are getting. YOu can probably find an employer who hires foreign worker with an LMO, (labour market opinion). You need this to apply for a work permit. IF they hire you an give you the lmo then you can apply for a work permit. make sure you never let any of your papers expire at aLL! IF your visitor permit is expiring make sure you are able to send an extension or application for work permit before it does. you do not want to have a bad record.

Now if you guys decide to get married. He can sponsor you right away after that BUT you still need the visitor permit or work permit or student permit to stay in CAnada while waiting for the PR. so back to the precious paragraph.lol.

There is also another way to go which is attach an open work permit with an in Canada sponsorship/PR application, BUT they will not start processing that until you guys are approved the first phase or what they call approval in principle. which will take 6-8 months. And still you will have to find a way to stay in Canada legally untill that comes.

So hopefully that sort of helps there's a lot of way and stuff to stay here. you just have to be patient and fast. time is of an essence don't wait till your paper work is expiring in a week to do something.lol. (trust me i've read posts like that) In which point there is not much they can do.

Thank you so much for your quick reply! I was unsure of the sponsorship or if we could actually get married or what we would need. I am more confident now to go ahead and start down that road. Since I do not need a TRV to enter into Canada (since I am from the US) I can not apply for one outside of Canada. However, would it be at all possible to apply for a TRV while technically visiting Canada?

I know that I am able to visit without a TRV as long as I can prove to the immigration officer that I will be leaving Canada after 6 months (my flight itinerary will show this.) But again, can I apply for the TRV being inland?

I am a United States citizen, btw.

If you are USA citizen you no need TRV. even you no need visa to entry or re-entry. You can come back to Canada any time. But please don’t be over stay. You said you have Steady relationship with your boyfriend for 3 years. You can apply spouse sponsorship by your boyfriend under the common law partner.

Regarding the common-law partnership. We are asked to provide proof of our relationship for more than 2 years. We do not have joint accounts open anywhere. Nor have we lived in the same residence for over a year. (Longest stay was 3 months by ME to Canada to his home.)

You can only apply for sponsorship under the common law stream if you have lived together for a whole 12 months and can prove it.
Maybe better to get married if you are at that point of the relationship.

Since you are a US citizen the immigration officer at the border will be the one deciding how long you can stay in Canada.
I think based on previous posts I have read. You can still send a request to the CIC to extend your stay 30 days before your stay will expire even if you are a US citizen. But you will have to prove the reason of your stay in this case spend more time with your partner. (get married etc)

Or maybe you can exit Canada border (driving and come back a few days later) I do not think that they can stop you cause again you are a US citizen. As long as you do not over stay at ALL. (this is just my opinion).

You guys lived 12 months in 3 years? no need a joint accounts. if you have any kind of letters like residential proof or leasing agreement etc.

it is the best idea to get marriage in Canada. and take lot of pictures. apply the PR application in-Canada. you will get possible results soon if you are genuine. then you no need to go USA. you can stay until the sponsor application get approved.
