Hello,

I am welder with 1 year degree program done in a community college/USA and 3 years of experience in the field.
There are many provincial programs that I could apply to immigrate to Canada, such as Nova Scotia and Morden.
My English score in IELTS is 8. My only concern is that I over stayed my visa and have lived in USA for 10 years undocumented.
No criminal records. Will it be a serios issue to qualify to immigrate to Canada???

Thank you so much for your help.

Your illegal status in the US won't be a problem provided you are honest about everything in your application. However you won't be able to apply through the US since you have no status there. Your application will have to be processed through your home country's visa office and this is where your passport will have to be sent for visa stamping. Additionally, you will have to travel to your home country if an interview is required.

I think one complicating factor is your work experience. Most Canadian immigration programs require work experience and I'm not sure your illegal work in the US will be considered.

You should also be aware that you will be automatically banned from the US for 10 years as soon as you leave. Getting Canadian PR status (or even citizenship) won't change the fact that you have a ban.

Good luck.

Thank you Scylla for your quick response :)

I am aware of the ban, but I see a brighter future in Canada.
The experience work I have in USA may not be cosidered because of lack of prove?
I have paycheck stubs and could get a remendantion letter from my work that will show the period of my employment. Will it help?

Best regards!

I don't know if your experience will be accepted or not - but you can certainly try.

Good luck.

Your work experience would be considered if you can provide evidence of it, it has nothing to do with your immigration status. I know a person that was on a similar situation as yours, after many years applying for asylum, he just couldn't take it anymore, he did apply under the FSW program back in 2009, and on 2011 was requested to go to his local embassy for an interview, at that pont he let the USA and continued the process from his home country.

He is now in Calgary. Please keep in mind that you can do all your paperwork here in the USA and send it to your country of citizenship and/or permanent residency, when they call you for an interview, then you leave the USA, do not forget to take with you an updated crminal check background from trh FBI.

Hope this helps...
