I have a small problem and wonder if someone can help:

On my Birth & Baptism Certificate My First Name is written: STUART
On every other official document (Passport, School Leaving Certificates, both Degrees, Voting Papers, Employment Records, National Insurance, Tax Office, Driving Papers etc.) My First Name is written: STEUART (so with an extra "E")
I discussed this with the "Dept. of Registration of Births, Deaths & Marriages in the UK" and they said that unless I have proof that this alternative spelling was used on a document before I was 1 Year old then "officially" I have the name that I have NOT used for anything over the years. The only way was to change my name is by "Deed Pole" but then are all my documents invalid as they were issued BEFORE this "Name Change"?

I went to the British Embassy here in Vienna who issued me with a "Statutory Declaration" (with all Letter Heads and a Seal!) which I signed under oath to declare that I have never used any other name. This is sufficient for the Embassy to issue my Passport but not for the "Dept. of Registration of Births, Deaths & Marriages in the UK"....but who has seniority?

My question is: Should I declare this on the IMM0008 Sched. 1 (Point 3.) and submit the Embassy Declaration or Ignore it or change my name officially (because of an "E")?

I am nervous that when they do a background check they don't know who I am or find this bizarre small point out - although the ONLY document with this spelling is my Birth Certificate?

I would very much appreciate some wise advice! Thanks and cheers AlbaVienna

I don't know what is the right thing to do, but this is what I would do.

1) write a letter to CIC explaining the mistake and why it cannot be changed so easily (don't confuse them and don't give them any more details than they require because it can get confusing).

2) there is a space for other names that you may have (or something like that), write one name in the official space and one name in that space.

3) I don't know how UK works but I would not think just a name change should invalidate your other documents. You should speak to someone in the UK, perhaps like a lawyer. Besides that, I do think if you do a name change, you will receive a document. You may need to show that document every time you think some agency has a recourse to look into your past (i.e., search on the name Stuart)

4) Back to CIC requirements, wait for others to reply.

I totally agree wid canadavisa4me, as I had the same problem wid an E, I would recommend u consult a lawyer.. Wat i did was I attached an court affidavit with my application stating the misinterpretation of the name in the documents and CIC was satisfied... this is surely not a major problem.. dont stress about it!
