Hi,

I am applying for Express Entry via the Canadian Experience Class Stream. I have work experience of 1.5 years at Company A as a Software Developer. I recently switched jobs and am currently working at Company B as a Software Developer. Both of these work experiences have been gained in Canada. I have an open work permit.

I have to answer the following question while filling out my Express Entry Profile.
Was a positive Labour Market Impact Assessment (LMIA) issued for the job offer in Canada? (required)

I have researched the internet about LMIA and I have put "No" as my answer. Can anyone confirm if my answer is indeed correct? Or who should I reach out to get an answer for this question?

The offer must:
  • be for full-time and for at least one year
  • meet different requirements depending on type of job (i.e. some need apprenticeships and certification) and
  • be non-seasonal for Federal Skilled Workers.
I have answered "Yes" for this question as I do have a job offer (from Company B where I am currently working).

Did you read the link under ”different requirements?” You are on an open permit, not on a LMIA. You answer NO.

Yes but the same link says the job offer is also valid if you have a job that is exempt from needing an LMIA. I assumed that was the case for me since a regular software engineering job does not need an LMIA. Is this assumption incorrect?

Are you on a LMIA-exempt permit? That is the question. You are on a open work permit not on a LMIA-exempt permit. If on open work permit, your answer is no.

Yes, unfortunately this assumption is incorrect. For what it's worth, this is a common misunderstanding.

As said above, because you are on an open work permit with no employer named, an approved LMIA is required in order to claim that you have a job offer.
