Want to stay in Canada after expiry of permit

Here's my situation. I hope someone can help me.

I am currently on a work permit that's due to expire in a few weeks. I am being offered jobs in my field (film/game media industry) but I am still a junior and extending or getting a new work permit for me requires that I also get an LMO, which is something that the company is not ready to help with.

As a result of this, I am afraid my work permit will run out before I can get another job.

If this does not happen, I want to stay here till my apartment lease expires and other related issues (not having to look for someone to live here with my roommates, properly closing all connections to Canada like phone, internet, taxes, etc). This would be by early/mid February.

Do I need to apply to extend my stay and restore my temporary resident status as a visitor (IMM5708E)?

If your work permit is expiring in a few weeks, you need to submit the "Application to Change Conditions or Extend Your Stay in Canada as a Visitor" ASAP.

You do not need to restore your status. Restoration is only for those who have allowed their permits to expire and now have no status in Canada.

Also even after your permit's expiry, i believe there is a 90 day period with in which you have to leave Canada. You probably cannot work during that time (unless you have applied for wp extension before original expiry and are under implied status).

This should be sufficient to cover you time line.

fkl, say you take that risk and do stay in Canada and continue working under Implied Status.. So you do that for a whole year or however long it takes to get your work permit or PR..

What happens when you do go to the boarder and get a new work permit or visa? Wouldn't they be VERY annoyed and Angry that you didn't leave Canada and even more angry that you continued working?

I am worried that If I do keep working later on down the road the boarder guys will see that I didnt leave.

You are ONLY under implied status if you applied BEFORE expiry of your visa and haven't heard back from them yet.

This almost never would take a year from inside Canada. As soon as you get respnose, you either have gotten approval or you have to leave Canada with the same 90 day time line being applicable.

The details of the last part are a bit hazy to me. But the concept is clear. If you have followed their instructions and it is CIC which hasnt responded to you yet, you can continue working, but it would never get to a year long time.

Also note, the "implied" status does NOT apply if you applied AFTER expiry or permit. You might still stay for the 90 day grace period and wait for your decision but cannot work during that time. If you do, that can lead to deportation.
