Want to sponsor spouse but stay with him ... PLEASE HELP!

Hey everyone!
So I've just spent the last three hours scanning this site, which btw has some great information.
But then I thought, why not just register, and hopefully someone out there will be willing to help!

first, our story in a nutshell ...

I am a Canadian Citizen (born and raised) living in Canada. My husband lives in Pakistan (currently).
We met last May (2011) .... through some mutual family friends.
We really hit things off, etc etc ...and got engaged in the beginning of June.
We went and got married in Dubai in July 2011, had about 70-80 people fly in for the wedding.
Reason being I didnt think he would get a visit visa to pakistan for this reason, and because Pakistan was not safe at the time. Dubai seemed like a good middle ground (and an excellent honeymoon destination ;))
we lived there together for 2 months after the wedding, and then I came back here and he went back to pakistan.
I have not yet visited him because 1- The conditions there are just getting worse and everyone has basically talked me out of it for safety reasons. 2 - Im working at the moment.
(however we speak multiple times a day, are very much in love, all that fantastic stuff ;))
Now, I want to sponsor him for immigration.
He has a potential opportunity in China, for a dental internship, and so im thinking i should sponsor him from there (because its so much shorter than Pakistan)
And yes I have looked everyhting up regarding this, and asked Canadian Immigration multiple times.

But can I go live with him once hes there and Ive sponsored him?
I also have tentative job opportunities awaiting me there. When the China idea came up i thought I would apply and see where it goes.
So if i go there to work, Am i allowed to do this? Or am i only allowed to visit? OR do i have to stay here in Canada?!
Now, I know the official rule.
Im a citizen so i Dont have to be here, i just have to show proof that we plan on settling here once he has his PR card.

But what is proof? I mean he wants to practice here as a dentist, my whole world is here, he has a very large family here.....we absolutely do want to settle here.
We have a financial support system from my side and his side so that even if we take some time to get on our feet, we have help.
How would I prove that sufficiently enough that they will believe it?

We're both on one year visas if we go....is that enough?

I would really appreciate some personal examples/ experiences.
I understand the rule, but i just dont understand how they would determine whether or not we are planning to settle here.

otherwise, Im leaving it all upto fate. because we're a genuine case and i dont see how they wouldnt believe that. I just dont want to delay or ruin anything by going there while hes there ....
has anyone else stayed with their spouse outside canada and come back with them as permanent residents?!

I feel overly paranoid but I'm panicking about this, please help!

Congratulations on your wedding!

As a Canadian citizen, you may sponsor your spouse even if you are living abroad (Permanent Residents may not). However, if you do so, you must prove your intent to move back to Canada two ways: by signing a statement to that effect on your application and by writing a letter and attaching any proof you may have.

Everyone's situation is specific. In your case, I would write a letter explaining everything (as in your post) and share proof of your wedding, communication you had before and after your marriage (phone bills, e-mails with each other and with each other's families) and wedding details (photos, list of guests showing they came in from many places for both of you, perhaps a selection of cards, etc), honeymoon photos and bills of when you lived together in Dubai in addition to any joint financial assets you have or other intertwining of your lives.

Should you decide to go to China for a year you can think of it as adding proof that you are willing to move to be with your husband so it really is a real relationship and just would need to explain in your letter that it is a temporary position and anything you have left in place to be able to go back to Canada easily (e.g., didn't move most belongings, have offer to go back to your job or plans to get another one, and letters from your family and his family offering the help that you outlined in your post above). Some people add to-do lists to show they've thought through what is required.

Based on what you say, you have a story that makes sense and you are both doing everything you can do be together in the meantime. Start filling in the application (you may find it's easier to do while you are still at home with easier access to all your old photos, letters, etc)

From your post, you seem detail oriented and meticulous so that should make your application pretty buttoned-up ... ask yourself if you showed the packet to a reasonable stranger with no verbal explanation from you (everything is explained in letters/notes in the application) would they believe you had. Genuine relationship and were planning to live together in Canada? If so, send it off. If not, what gaps do you need to close to convince that random stranger? Address those and send it off.

Hi OhCanadiana

I have a new question.

I called Cdn immigration and the woman wasnt really able to answer this..
I will call back and hopefully get someone else who can answer my question but I thought Ill ask you as well

Im applying for jobs in China as you know so that my husband and I can be together during his immigration process
and he is applying as well, from Pakistan.

If i get a job there, they will give me a Z visa, which is a one year working visa valid for me and any accompanying family members.

And I know that in order to apply for his immigration FROM china he would need a one year valid visa and be present there.
My question is, if he comes with me on my Z visa, can I apply for immigration through that Visa?
he would technically have one year valid entry as my dependent.
Or would it have to be a one year visa directly issued to him??

I really hope you can help me with this!

As long as he can legally live in China for a year you'll be fine :D.

The risk you'll take on with this approach is that if for some reason your application isn't completed at the end of the year and you decide not to stay at the job for another year you won't be able to transfer the application elsewhere so just make sure he'll be able to travel to China if an interview is requested.

By the way, if he wouldn't be working in China - have you looked into trying to get him a tourist visa to Canada? I know it can be hard for some folks especially after marriage but it may be worth considering. If not, just make sure you keep proof of your intent to go back to Canada once his visa is approved.

I have considered a tourist visa.
But I've been somewhat scared out of it, just because I have heard its near impossible ..

Also, because he does intend on working, its just I may get the work visa before he does to China, and so if I can apply this summer we'll save a few months.

If i explain to them that we're moving to China so we can be together, that he wants to study and practice in Canada (dentistry) once he gets there

Also that ALL of my family and a large portion of his is here in Canada...

For intent to return, also add in details of the logistics you have planned - why China and not temporary visa, how you intend China to be temporary and therefore left your belongings mostly in Canada, housing arrangements for when you return, conversations with your employer about returning or other job prospects, etc. They seem to be increasingly asking for details on intent to return especially for Canadians who moved away from Canada just before or during the sponsorship process so to save time, be proactive and detailed in your explanations. :)
