I am a US citizen and my girlfriend is a Canadian citizen. I am very well educated (medical doctor) and have a very nice job with the US government that I love. My girlfriend is very well educated, (PhD) and has a very nice job that she loves. She is also very close to her family and reluctant to leave Canada to come to the US. I love my job and I am reluctant to leave the US to live in Canada. Is it possible for us to legally marry then continue to live in our respective countries? If we marry but choose to live apart, what are our legal rights with regard to visitation and immigration? If we marry but live apart and I pass away (or vice versa) is she legally entitled to claim our joint property?

My friend , it is very nice to hear you love story, how could you get married , love someone and stay apart, what is the need of a pr or citizenship. cic will certainly not giving you any approval, either canada or us, yes you can get the pr , but have to maintain the pr obligation, your wife can stay in us with you and you will not loose the pr , but for how long???

Realistically as you don't plan to live in Canada and she doesn't plan to live in the US it shouldn't be an issue really. You can visit her and she can visit you, it may raise a few questions at the border but it shouldn't cause a significant problem. As neither of you will be permanently resident in the other's country why bother with applying for Permanent Residency and citizenship?

Regarding the entitlement to property and assets in the result of the death of one of you, you'd need to seek legal advice on that. If I were to hazard a guess then I would assume that as a spouse you are the next of kin and would have that entitlement.

Why marry in the first place?

You will not leave your job
She will not leave her job
She loves her family
I am assuming you love your family

You can have a long distant relationship see each other occasionally with out any strings attached, this way you can break up easily without any obligations or complications such as property, joint account, half of what you have is hers and all that non-sense etc
The whole idea is to reduce complications in life so you can enjoy things you love doing why make life more complicated than it already is?
