I’m considering immigrating to Canada, but my situation is a bit complicated, and I’d love some advice or to hear from anyone with a similar experience. I recently went through a divorce and currently have joint custody of my daughter. Now, I’m wondering—if I move to Canada, would I be able to apply for full custody? What are the rules around custody for immigrants in Canada?
I’m trying to make the best decision for my daughter and want to understand what legal options I’d have there. I’ve read that family law varies by province, so it’s been hard to find a clear answer. Has anyone here been through this, or does anyone know about the custody rules in Canada?

Is ex allowing you to possibly take child out of the country? This is a family law issue in your home country whether you get full custody to bring your child to Canada. If you want to immigrate and don’t have full custody then your ex must allow it. If ex allows you to take child to Canada, then you will need to set up joint custody schedule if ex allows it.

How are you immigrating to Canada? With drastic cuts to immigration, you must meet a higher bar.

If you want to obtain sole / full custody, you need to do that through the court system in your home country, not in Canada.

If you want to move your daughter to Canada without having sole / full custody, then your ex needs to provide written permission for your daughter to move to Canada with you.
