Hey
Me and my Canadian citizen wife want to birth our first baby in Canada because my wife is not Canadian born but she get her Citizenship on her birth.
My PR case will hope fully end this year may be sep 2014 or Dec 2014 after that we will move to Canada and want to make our baby.
My wife is working out side Canada since 5 years, she have her OHIP card now i want to know can we make our baby after landing in Canada or she have to wait for her OHIP like some ppl told me you have to wait 3 months after landing is that true? Like in starting 3 months we can not make our baby?

Why not move to Alberta, get AHCIP and immediate coverage (no waiting period v. 3 months for OHIP)? If you are moving or returning to Alberta from outside Canada, you might be eligible for coverage on the date of your arrival and don't have to wait 3 months to start parenting!

If your wife has been outside Canada for 5 years, she has most likely lost her OHIP. Returning to Canada, she would have to apply for a new card and would get coverage in 3 months.

If you move to another province, pretty much any province except ON, BC or Quebec, you would get instant coverage. However, in order to be eligible for health care, you need to be planning to reside in that province so after arriving, you should stay for at least 183 days (6 months). Otherwise, you risk that your new province may decide that you were never eligible for their health care in the first place, cancel your coverage retroactively and make you pay back what they covered for you.

My wife have red color card and some one tell us red color card without photo still working without renew is that true.
Also one more thing after my landing if i want to go out side Canada for 4 to 5 months after apply my health card will it be ok or i have to stay there 183 days then i can go?
Or i should not apply my health card if i want to go out side Canada.?

The red colour card you are taking about is the old OHIP card. Yes - the old OHIP cards are still accepted. However because your wife has been outside of Canada for so long, she is no longer covered by OHIP and the three month waiting period applies to her when she returns to Canada. You can certainly try using her old OHIP card. However OHIP may come after you for the costs of any medical care your wife improperly uses during the three month waiting period. To make sure you don't end up paying for her medical care out of your own pocket, she needs to return to Canada and live in Canada for three months before using OHIP again.

The three month waiting period has to be spent in Canada. You can't return to Canada, apply for OHIP, leave for 4-5 months and then return and use OHIP immediately. If you plan to land and then leave Canada for 4-5 months, then you should wait until you return to Canada before you apply for OHIP. Once you return to Canada, you will have to wait 3 months before you qualify.

OHIP has a rule stating that you must stay in Ontario at least 153 days a year and if you are a new or returning resident, you have to stay 153 days out of your first 6 months. That means when you settle in Ontario, you can not leave for more than 30 days combined in the first 6 months but they will give you an OHIP card after 3 months.

If you landed in Ontario and did not stay or plan to stay for 5 months out of the first 6 months after landing, you were not eligible to apply for OHIP anyway so it is good that you didn't. When you return to settle, you stay 5 months out of the first 6 after your settlement arrival and then you will have no problems with OHIP.

If you return to Canada knowing that you do not plan to stay for 5 months out of the first 6 after arriving, you are still not eligible for OHIP.

If you plan to stay 5/6 months, apply for OHIP, get your card but then leave and do not spend 5/6 months after all, you should inform OHIP and they will decide if you lose your OHIP again and have to do the 3 months over again on your return.

Not informing OHIP that you are no longer eligible can be seen as fraud and could cause them to backcharge you for bills they have already paid for you.

If you are not going to apply for OHIP, you do not need to stay after your first landing. You can apply for OHIP when you are back to stay.
