Waiting on PR decision, temporary status about to expire

I applied for my PR under CEC on Feb 8, 2016. Yet to hear back on the decision.

My Visitor record which got extended for 6 months in Jan 2016 is about to expire (July 14, 2016). In case I do not get a PR by then, what am I supposed to do? If I apply for Visitor record extension online, processing time is 2 weeks, they may refuse extension as I have already been a visitor for a year now. If I apply via paper, processing time is 3 months and if I get my PR call by then, I will be out of status with application in process. This means I can not go to the border to get PR and instead will have to go to my home country and come back to Canada to do landing.

Any suggestions would be much appreciated.

Best.

Apply by paper to extend your visitor status. You will have Implied Status until they make a decision. Provided you show sufficient finances and proof of the PR app in process, you have a good chance of approval.

You just applied in February. PR processing time under CEC is usually 12 months. Let's have that in mind. Now if you do what Canuck_in_uk is telling you, you will only have 6 more months tops to stay here, considering that you have already passed 4 months you will lack another 2 months maybe more. Regardless you will need to get back home, not to mention you will have a confusing stay status.

The best thing I would suggest that you do if possible, is to get back home and await your PR result. There will be no harm and no change in your application process. Staying clean and getting along with rules and regulations is the best thing you can do.

There is another option that I would not suggest, but you can dig into it if you are super desperate. You can get a student visa, meaning you will enrol yourself in a government certified school and with the admission letter you will go to the border to get your student visa. How ever this part is a little tricky cause the rule is that you will need to go back home to apply for your student visa. But I have seen it happen at the border since the immigration offices down there have the power to issue you the visa. Considering that you will need to be packed financially, both for your studying expenses and living expenses. Worse comes to worst you will be denied a student visa, you get your admission fee back from school and stick to your plan A. Read about flagpolling, you can do it on your visitor visa, but you will need to explain your situation to the officer thoroughly. Having your AOR in hand helps.

Again I would not suggest the student route via flagpolling but it's an option if you want to stay here till everything gets finalized. Dig a little more into it. Don't rush anything and stay calm.

Pay a visit back home, family should be missing you. ;)

Best of luck,

Hello rezafc -

Isnt processing time 6 months under CEC if applied via Express entry? I was under the impression that the decision will come in 6 months or less.

Please advise.

Thanks.

Hello, apparently it is. I'm an old applicant, so I thought it's 12 months.

Best of luck,

Many will, IRCC's goal is to process 80% within 6 months... that means that 20% will not be processed in 6 months, and IRCC often does not have the resources to meet its goals.

I am thinking of sending a paper application for extension of Visitor Record.

Have a question, if Permanent Residency IA gets approved after expiration of current temporary resident status, I'll be on implied status if I have a temporary resident extension application in processed and submitted before it expired. Can I still go the border and get my landing done? Given I won't have any valid temporary resident papers, would this be a problem? Or would I have to go home and then re-enter Canada to do my landing?

Any thoughts / advice would be much appreciated.

Thanks.

Yes, you can still flagpole at the border to land. Carry the extension receipt in case CBSA can't see the extension in their system.

Given i am submitting a paper application, what proof can i show? Payment receipt and mail delivery confirmation.

Please note I won't get any confirmation from cic that application has been submitted given it is not an online submission.

Please advise.

Make a copy of all the documents (every individual paper) you are submitting. Make a copy of your post & payment receipt and tracking number. Put them all together in a folder and name it visitor extension application. Have it on you when flag polling.

Best of luck,
