VO switch?

Our outland application was sent to Mississauga JAN 2013, SA has been granted, application sent this week to Manila for further processing. If I (sponsor) were to take a short term job post in Europe that has potential for renewal/extension and decided to bring my Filipina wife there on a Schengen visa to start (which I can do as a dual UK-CAN citizen), I'm wondering if CIC would allow for transfer of the application from Manila to Paris for completion, or would they require a completely new application be submitted in Paris? As much I know we are at their mercy I also want to get on with life. (I guess a bit of bet hedging too, as there is absolutely no guarantee of getting the CAN visa.) Perhaps too much to ask? Appreciate any opinions/suggestions. Thanks!

If you leave Canada, you will then have to prove your intent to return to Canada once your wife is granted PR. Are you prepared to do that from another country? If you can not prove your intent to return then your wifes VISA will undoubtedly be denied.

First off, the choice of what visa office to use for processing is entirely up to CIC, not the applicant or sponsor. Rules for requesting a certain visa office, require that applicant has been admitted to that country for at least 1 full year. So if her visa to EU was valid for at least a year, then technically you could request the switch.

However there is no guarantee CIC would consider your request, and could keep processing at Manila regardless based on her citizenship.

Also i've heard many stories of cases getting transferred midway from one office to another, and then seeing incredibly long delays. There is more chance part of the app will be lost if you ask to transfer at this stage. If it was me, I would just keep things at Manila office, even if you both move.

Yes, of course I would indicate intention to return to Canada...but it's kid of dependent on getting the visa for my wife too, "chicken & egg" scenario in a way. Very complicated, I know, as I would also have to inform the European employer within a certain time if I/we would just stay there.

OK, thanks for the feedback. In the latter case it would require my wife going back to the Phils at a certain point (when the passport is requested) and then waiting however long it will take to get that back. Plus we would have to "land" in Canada to validate the visa before it expires. Lots of intricate planning but doable I suppose, with least amount of risk for file loss or CIC objections.

Unless your spouse has some serious criminality issues or they just don't believe your relationship is genuine, the odds of a refusal are pretty slim. But as stated, you can indeed leave Canada because you are a citizen and you can while you have an application in process. Rob answered your question about changing your VO.
