Visitors Visa Extension Refused - Urgent Help Needed

Hi all,

I am applying for FSW Arranged Employment and was staying in Vancouver on a Visitor's Visa in the interim period. Unfortunately today I received news that my visitor's visa extension was refused. It did not say exactly why but gave 5 general reasons and said that the officer felt I did not meet the requirements. After speaking with some people on this forum it might be due to the fact that I asked for a visa extension based on my application for residency and wanting to stay in Canada in the interim period. I told them, which is true, that I have been staying in a meditation centre and not seeking work the past couple of months.

1. I am wondering what the chances if I go to the border and try again that they will approve me if I tell them that I will now seek professional employment here immediately and would like a visa extension to find something suitable?

2. Or if I went to the states for 3 months and tried again after that would there be a greater chance that they would let me back in then? (I would prefer the first option).

3. If I call the helpline and quote my case id and officer id nr will they be able to give me specific advice such as why exactly I was refused? ( I doubt it!)

Any advice on any/all of these questions would be greatly appreciated.

Thanks,

Derek

It is extremely unlikely that you will be re-admitted as a visitor for the 6-12 months that it will take for the PR to be processed. You really should plan on going home.
The Call centre will just tell you to read the letter, they will not give you the information that is contained in the FOSS notes, you would have to apply for them under the Privacy Act. http://www.cic.gc.ca/english/department/atip/faq.asp

Thanks PMM,

I called the helpline today and the official read my file and told me that it said the reason it was rejected was because I had "met the requirements of my stay in Canada" and therefore there was no longer any reason for me to be in Canada. The agent said if I wanted to apply for restoration status I could do so but would need a new reason to put in the application if they were to consider it.

1. Would it be any disadvantage to my PR application if I was to apply for a restoration of temporary status? Does this look bad on my record if this is refused?

2. I am thinking of seeking employment now (as a IT worker) and could resend this information as a new reason to stay? I have already been granted a 6 month visitors visa on the grounds of seeking employment so perhaps it is unlikely that they would grant me a second one on this basis since I did not find employment within that period?

3. If the 6 month visitors visa was approved, this would still be from the starting date of October 21st so if it takes 3 months to process the restoration of status application, this would mean it would have expired at this stage anyways, so in reality all this application would do would buy me time?

Many thanks,

Derek
