Visitor Visa -URGENT..PLS HELP

Gurus,
I am working in US since 2007. Unfortunately My I-94 expired on Jan 23 2010 due to passport expiration. I have a valid h1 visa till September 2010. I've also got the visa extended till October 2012 but without I-94. My new 797 indicates I've to leave US and comeback. My questions are

Can I get Canada Visitor visa with expired I-94 at Consulate in NYC?
If I get the visa, Is it better to show the new h1 797 to get the I-94 till 2012 or to show old 797 valid till september 2010?

Please help me ASAP as I am planning to go to NYC tomorrow for visitor visa.

Bring anything that will show proof of your status and ties in the US. They want all the originals. They'll give all originals back to you after your interview with the officer. You have to arrive on or before 10:30 a.m. and must have the exact amount for the fee.

Hmmm. Am not really sure but considering you have a valid H1, then I would hazard a guess that you have a good chance obtaining a visitor visa for Canada. Your only purpose is to renew your I94, wasn't it? Also bring proof of current employment and anything that will show you have reason to go back to the US.

Thanks for your response. Yeah, the reason for me going to canada is to get new I-94. I do have all the documents like client letter,employment verification letter, pay stubs, w2 and tax returns etc. Hopefully it'll be a success. I really appreciate your input in this regard. Thanks again

I got my canada visitor visa today at NYC. Thanks for all the help. Now in order to get new I-94, I want to drive to Montreal and comeback. Please let me know if they take my old I-94 at POE canada and while coming back they can give me new i-94. Planning to drive today. Please advise.

Congratulations! Normally the officers won't take the I94 when you enter from the US. Ask the officer to take it. Explain that you are driving across the border to renew your I94. You never left the US since you arrived there?

When I came back to US in last week of december 2008, at port of entry the officer loooked at my old passport and since it was expiring on Jan 23rd 2010, he gave I-94 till this date though visa is valid till september 2010. Canada border, maybe not since you just want to surrender your I94 and you have a valid visitor visa. They may ask you at CBP though (the American side when you enter again), Ams are a bit paranoid. Anyway, you stayed because you're working there.
