Hi there!

Here is my situation and I hope you can help me with this.

I am a canadian/argentinian citizen and have been living with my common law partner in Argentina for the past year. We met in 2016 and i came back to Argentina to live with him. It has now come to the point where I would like to move back to Canada and bring him with me so he can meet my family and also start the sponsorship process over there also to see if he adapts to the country. I want to apply for a visitor visa and dont quite know what to do. I was told visitors visa get denied for common law/spouse. My parents made him an invitation letter saying they will care for him and his needs and we will stay in their home. I even made a letter myself stating my intention of becoming his sponsor so that we can go through the process together.
if not I mean, we have a work letter from his boss, our apartment contract who ends nov next year, his whole family lives here and we have 5 dogs (lol) i dont know what if this would be enough. we dont have a lot of money because the pay here is horrible, which is why i want to go back. I am kinda annoyed there isnt a visa for spouses/partners yet , he has never been to canada and I want to make sure he likes it before having to be apart and go through that whole process..

Generally, spouses/partners of Canadian citizens and PRs find it quite difficult to get TRVs. It could be quite difficult to prove your partner will return to Argentina (he would be financially dependent on you/your parents + the apartment contract ends in a couple of months + not sure if he has traveled to visa-required countries, etc).

You may want to consider sponsoring him for PR under Family Class if you have been common-law for least 12 continuous months. You don't need to move back to Canada for this. You can start the process when you're in Argentina

Thanks for the reply! i have a question though, can't i state my intentions are to apply for the inland sponsorship, and thats why he needs the visa? as Double intent...i miss my immediate family a lot but i also dont want to be apart from my partner and this seems like the best way to go about it..

Normally, dual intent does not work for applicants who are applying from outside Canada. Unfortunately, stating this dual intent could ensure a quick TRV refusal + your partner could be refused because of the apparent lack of strong ties. Spousal PR applicants are expected to wait out the PR process in their home countries.

IMO, a TRV application may only result in disappointment, loss of time and money. If you want to give the TRV application your one best shot then I recommend proving that you (and of course, your partner) have strong reasons to return to Argentina at the end of a short visit

Oh okay thanks! so then if go for the Family Class visa and apply over here in Argentina, can he get permission to come with me to Canada or we need to wait the whole year here ?

A downside to using this stream is that until your application has been approved, living with your spouse may be difficult. He may get a TRV if he applies when his PR processing is in the last few stages. Again, the TRV approval would depend on the strong ties he can demonstrate + hopefully he has traveled to other visa-required countries. etc.
