Hello,

Below are a couple of key points that'll make you understand the whole situation better.
  • I'm living in Canada for over 3 years now and I'm on a work permit.
  • My father passed away in May 2021.
  • My younger brother got to Canada on a student visa in May 2022. If I apply now I have to put his current address in Family information.
  • And I'm trying to get my mom to Canada on a Visitor visa temporarily until I get my PR and get her Super Visa.

On top of that, I am also full-time employee who secure enough to support my mother on her upcoming Canada Trip. Last but not least, I am ready to execute a bond to assure her repatriation.
I depend on my mother emotionally like never before as after the demise of my father, she is the one whom I am so close with. I humbly request to grant her Canadian Visitor Visa to make our family reunion possible.
I understand that I can fly to India and spend some time with her but I want her to visit Canada and witness the beauty of this country which will vouch for her better mental state especially after the demise of my father."

And a letter from my mom said:
"The purpose of travel will be social and family reunion as I am longing to see my son during these times of uncertainty. Looking at the fragility of life, I want tospend some time with him as it has been long time since we sat together and talked our hearts out. Moreover, after the demise of his father, there is nobody closer to him other than me with whom he could depend emotionally and talking on phone is not doing justice to the emotional bond that I share with him."

So a few things:
1. Don’t reapply again for a while (6 months). It looks desperate on her part.
2. Funds - Your funds are not considered so focus only on her funds. Keep visit short to 2-3 weeks. Saying you will support her showed that she cannot support her own vist.
3. Funds - How is she all of a sudden increasing funds - red flag>
4. Purpose of visit - So you said you can visit her? You need a valid reason for her to visit since you said you can visit her.
4. Ties to home country - what are her reasons to return? Job, investments, property to maintain, caregiver etc.

This is a tough situation and I think you need to plan that it will be a while before your mother can get to Canada.

- Your brother having a study visa now increases your mother's ties to Canada and means you have to strengthen her application significantly.
- I agree with the recommendation to wait 6-8 months before applying again. Don't apply again now.
- I get really confused regarding the conversion from lac to CAD. How much in savings does she have in CAD?
- Your funds are low. I would increase them if you can.
- The letters you wrote didn't do you any favours. They were a bad idea. The letter from your mother makes it sound like she is in an emotionally fragile state and sees you as her next closest family member now that her husband has passed away. The next time you apply, don't include letters like this. All they do is increase the concern that your mother plans to remain in Canada long term (which is actually what she plans to do). The letter makes it seem like she's not independent and needs you, which again, makes IRCC more concerned she wants to live here with you and isn't a genuine visitor.
- What is the source of your mother's income? (sorry if I missed that above)
- Is she living with her father / your grandfather?
- Does your mother own property? Did you include proof of this in the application (sorry if I missed that above)
- Does your mother have previous travel to countries requiring visas such as Canada, the US or UK? (if so, include evidence of that next time)
- You mention that your mother lives in India alone and it's very difficult for her to do so given her age. I think it's unfortunately not realistic to think that she can live with you in Canada from now until she can become a PR. Let's say she manages to get a TRV approved - at some point you should assume she will still need to return home and live there for a while. In the application, you want to show that she is able to do this independently. If it looks like she can't, it's going to be very difficult to be approved.

Are the funds you mention your account of her account? As @scylla mentioned your letters are going to haunt you because you have essentially indicated that your mother wants/needs to visit Canada longterm and not return home. Even if applying for a supervisa there are still no guarantees of PR in Canada so she needs to provide ties to India and needs proof that she has sufficient ties to return home.

  2. Ties to Home Country - She has got a rental property to maintain and all the property we showed is under her name, she doesn't do a job but runs a home-based boutique(tax return).

  1. 1lac to cad is approx $1600, so we showed over $10k CAD in her account.
  2. Income Source: home-based boutique(tax return) and rental property.
  3. My mother is living with my grandfather, that's right and that's why we also included his income reference and tax return.
  4. My mother owns all the property, and it's worth $300k CAD as per the documents we attached.
  5. She doesn't have any tourist history.
  6. All I want is to get her a tourist visa with multiple entries and then we can get her back and forth i.e after 5-6 months of stay in Canada and a visit to India for a couple of months.

At this point in time, I'm just looking forward to getting her a visitor visa and she gets to visit us in Canada, When it'll be time to get her a super visa/PR lot of other things will change, for ex: I'll get married in next 3-5 years and have kids, until then we'll get through the time on a visitor visa and Super visa accordingly.

Thanks to all of you guys for sharing your views on the case, I noticed that my agent has shown the duration of 6 weeks in two different letters which is more than our previous application of 4 weeks visit and this also dilute the funds even more.

  • Purpose: The purpose of the visit would be a family social and family reunion. I would love to see my mother with me in Canada and spend quality family time.
  • Ties to Originating Country: My mother has strong family and financial ties in India. She secures a handsome income and also owns movable/immovable assets.
  • Traveling Span: She will be staying in Canada for a period of 6 weeks in the coming summer and I shall take her to the famous attractions in and around Barrie, Toronto and Niagara.
----------------------------------My mom's letter
"My son would also take me to the famous attractions in and around Ontario. It would be a trip of 6 weeks starting from 25 July 2022 till 07 September 2022 so that we have enough time to build some more memories and feel the warmth of each other's company."

I think it's a stronger application if you provide the invitation letter since you have been living a while in Canada and are working. You are in Canada to support your brother so I don't think the homesick argument makes sense (just my opinion).

In my opinion you need to hold off applying again for 6-8 months. If you apply again now, I think there's an extremely high chance you'll be looking at another refusal.

Your grandfather‘s accounts shouldn’t be included. It is really up to your mother to support her own travel. You can include your own financial information as secondary information. Given that your brother has either just started his education in Canada or will be starting his education in Canada in September there will be concerns that your mother wants to relocate to Canada because her 2 sons live in Canada. Assume you are supporting your brothers studies so that will also drain a lot of your finances. In general your plan for your mother to spend 6 months in Canada then return to India for a few months and repeat the same cycle isn’t advisable. Your mother should be spending more or equal time in India and Canada as she is still a visitor in Canada and not moving to Canada. Agree that given the 2 refusals that reapplying right away will seem as though she is desperate to travel to Canada which raises red flags. There won’t be any dramatic changes to your application that would lead to a different conclusion if you reapplied now.
