Hello All,

I was confused and was looking for help and saw very reasonable and knowledgeable replies on this forum and hoping somebody could also guide me . Thx in advance.

I came in Canada with my family on Business Visitor Visa in March 2016 and was looking to extend my business in North America. After few months I decided to make Toronto as a base for my business in North America as me and my family felt more comfortable here as compared to US. To start the operations of the company, I opened a company with a local partner, submitted business plan etc and applied for work-permit . I had to apply for visitor visa extension and additional six month was given till march 2017, which recently expired . Before it expired we did apply for another visitor visa extension citing our work-permit file no etc and we expect to receive the answer in 2 months & till its answer we are under "implied status" .

The issue is that just after we applied for second extension, we received medical & biometric tests letter for our work-permit case. We did the medical but for biometirc they asked me to go to Newyork . I have US VISA as well so no issues going there but due to my extension of Visitor Visa and now since my Visitor Visa expired in the end of march and I am currently under "Implied Status" will they allow me to enter back in Canada .

Please advise as my wife & kids will be in Canada and if they do not let me back in Canada after I go to do biometrics in Newyork , it will create serious issues for me.

Thanks in advance for all your support . Cheers .

There is no guarantee that you will be admitted back. Yes, you might be refused entry, or given a short period so you can pack your things and leave. This is always a possibility.

That said, usually CBSA agents understand you are just going for biometrics and will give you no trouble as long as you carry with you all evidence of the process you are following, the intention of your visit and your status is a valid one.

(BTW, no such thing as "visitor visa", avoid using the term to get accurate advice).

Thank you Jalex23 , it was very helpful and cleared a lot of things in my mind. :) .
I have two more questions if you can spare a few moments :

1. You said in your reply that

"That said, usually CBSA agents understand you are just going for biometrics and will give you no trouble as long as you carry with you all evidence of the process you are following, the intention of your visit and your status is a valid one."

Is my status valid one at the moment as my visit visa expired in late march 2017 & i applied for its extension right before expiry and I am currently under implied status.

2. When I came from my home country I gave biometrics for processing of my visit visa , can't the same be used for my work-permit by writing a letter to the concerned authorities.

Thanks for all your support. It is very much appreciated.

Seems it is.

Yes, you can. When you took the medical appointment you received a receipt. Use this receipt for your new application.
