Visitor Visa before Family sponsorship in China?

Hi there,

My common-law partner and I are both living in China now, my parents are in Canada. I would like to go back to Canada this October and We would like to apply for the family class sponsorship. However, I would like my partner to be with me when I leave for Canada and while waiting for the application so we are thinking to apply for her a visitor visa, then once she gets into Canada, apply for the family sponsorship OUTLAND while in Canada.

Now for her visitor visa my dad will send her an invitation letter and the purpose will be to visit my parents, and I will also state that we might be getting married in Canada. Should I mention that we are planning to apply for family sponsorship in the visa application?

In the invitation letter, my parents will write that the duration of her stay will be 2 weeks because thats all the vacation time that her work place has allowed her and we need the leave certificate. But obviously, what we plan to do is to have her stay with me for the 6 months until her visa expires then apply for a extension. Do you think this would be a problem for the sponsorship? Will this seem suspicious for the sponsorship?

Last question, if she gets her visitor visa and goes to Canada with me, then apply for the OUTLAND sponsorship, does she have to send in her passport when sending in our application? or do we only send it in once its requested? and if its requested, and they ask her to go for an interview, she will be passport-less? How can she then travel back to China for the interview? a bit confused on this.

This will definitely seem suspicious to the authorities but you can always try. Your gf will have to be armed with LOTS of evidence that she intends to return to China after those 2 weeks.
I don't blame you for wanting to do this. In retrospect, it is what my wife and I should have tried to do rather than wait for months on end here in Beijing for an answer as to whether she qualifies for pr. Once my China visa runs out, it's unlikely I can renew and we will possibly be separated.
Getting the visitor visa and applying inland is the discouraged method, but if you can procure one, it is an assured way your family can stay together throughout the pr process. Good luck.

you mean she has to be armed with LOTS of evidence with her when she enters the Canadian border? But if she has gotten her visitor visa already, isnt that enough? can she possibly be still rejected entry to Canada even with a visitor visa?

as for suspicion, thats why i asked my dad to write the invitation letter and the purpose is to visit my parents, not me.

What I mean is that after she applies for a visitor visa, she may be interviewed by visa officers at the embassy. On the application itself, you are asked to provide evidence of your return to your countr4y of origin. Many visitor visas are rejected because the visa office is not convinced that the applicant will return after the expiry of his/her stay.

My husband is from Brazil. I wrote an invitation letter for him stating that he was my fiance and he was going to come visit me for a few months this summer, and that he will be making regular visits throughout the duration of his tourist visa (he requested a multiple entry). He didn't get asked to get an interview and they accepted it.
Once he got to Canada we had our wedding and his family members from Brazil even came along for the wedding.
The visa officer have him 6 months to stay here, so we are applying for outland PR in a few weeks once we have all of our documents together, and then we plan on applying to extend his stay.
