Can anyone advise is it possible to convert Visitor to Study permit in Phd Program (fully funded/Scholarship) inside Canada. without going through Pre-requisite course since I dont have 3 months time.
My baby is 6 month old Canadian born Citizen.
My and spouse both have Valid Visitor Visa (TRV-Temporary Resident Visa)
What are options,
1-Can I do flagpooling what is requirements and process?
2-Can I apply online as inside applicant, but what will be eligibility option apply to me?
3-Do I have to apply as outside applicant?

I am living with my spouse in UAE, which is third country to my home town. so ties wont be strong in application plus online outside Canada CIC website showing 13-14 weeks, which I dont have enough time to attend University.
 
You cannot convert a visa. You apply for a study permit and it is processed from home country.
1. Are you from a visa exempt country? If not, apply online.
2. You are a visitor so processed outland.
3. You can apply while in Canada but processed outland.

You have to show POF for 3 people so $31k. Having Canadian baby is not relevant and gives you no advantages.

My spouse working in Multinational company, he wont be accompany me and will not move from UAE. We have siblings and as baby Canadian Citizens.
POF 31K, Is my husband Bank statement will be suffice.
Home Country, I have moved out since last year March/2023 to live with my husband who is residing in UAE for more than 10 years, so shall I apply from home country or UAE (UAE never gives permanent residency).

  • Holders of temporary resident permits (TRPs) valid for a minimum of six months and their family members;
  • Refugee claimants and persons subject to an unenforceable removal order;
  • Protected persons within the meaning of subsection A95(2) and their family members;
  • In-Canada permanent resident applicants and their family members who are determined eligible for permanent residents (PR) status in one of the following classes:
    live-in caregiver, spouse or common-law partner, and humanitarian and compassionate considerations (H&C);
  • Persons whose study permits were authorized by a visa office abroad, where the permit was not issued at a port of entry;
  • Family members of athletes on a Canadian-based team, media representatives, members of the clergy, or military personnel assigned to Canada.

Tough to justify that you have H&C reasons to get PR in Canada. How much time have you spent living in Canada and what was your status when you had a child in Canada?

I don't understand the line that you bolded. You are NOT PR's family member who is eligible for PR. Your baby is too young to sponsor you as parent and your sibling are not your immediate family member to sponsor you as well. I don't see any H&C consideration and I doubt you want to work as a live-in caregiver (nanny/caregiver for sick senior).

The fact that you did birth tourism can also cause a big problem for you in the future. You could also face difficulties visiting and also could create issues for your study permit. Assume you didn’t declare that you wanted to give birth in Canada in your TRV application. Your only option is to apply online for a study permit.

How did you live in Canada? You were a visitor who came to Canada as a TRV. Given you came and gave birth you will need very compelling reasons to study in Canada. Having a Canadian child gives you no advantages. H&C is not even an option.

You don't meet any of the requirements to submit an application within Canada. You must apply using the outside of Canada process.

None of the things you have mentioned so far allow you to apply from within Canada.

I was given standard 214g form,US never inform reason, what shall I mentioned if I need to declare yes for refusal,
will mentioning refusal B1/B2 negatively affect application?

Yes, you must declare the refusal. Failing to declare the refusal is misrepresentation which will put you at risk of being banned from Canada for 5 years. Canada and the US share immigration information.

Negative impact or not, you HAVE to declare ALL visa refusals.
Otherwise, you are committing misrepresentation and could result in a 5 year ban from Canada.

You need to declare that in your study permit application or any future visa/PR applications.
IRCC can find out. US and Canada immigration share information.
