Hey All,

Hopefully, someone can answer this question for me. I was recently refused an extension on my visitor's visa, I'm not quite sure what to do next…. I was waiting on this approval so that I can move forward with my PR

What are my options for appealing this refusal?

If I cross the border will I be able to come back if so when?

How soon do I have to leave?

At the end of the day, I am the primary parent for my 4 children I can't just up and leave I'm terrified if I cross the border I won't be able to get back in and I'll do whatever it takes to overturn this refusal....


Below you'll find a copy of the actual letter that was emailed to me

Immigration and Refugee Protection Act and Regulations... "im not even sure with this is

This letter refers to your application for a Visitor Record.
Based on your application and accompanying documentation that you have provided, I have
carefully considered all information and I am not satisfied that you meet the requirements of the
Immigration and Refugee Protection Act and Regulations. Your application as requested is
therefore refused.

[X] An application for restoration must be made within 90 days after loss of temporary resident
status. You are not eligible for restoration of your temporary resident status because your
application was submitted after the regulated 90-day period. Since you no longer hold
temporary resident status in Canada your application for a Visitor Record is also refused.

[X] You are a person in Canada without legal status and as such are required to leave Canada
immediately. If you do not leave Canada voluntarily, enforcement action may be taken against
you.

From what you have posted, it looks like you are out of options. You will need to leave Canada as soon as possible and certainly within 30 days of receiving this letter. Did you, in fact, allow your existing visa/visitor record/entry authorization to lapse more than 90 days before submitting your application for a visitor record? I don't actually see the refusal reason in the letter, unless that was the case.

I sent it in before my Visa expired but it took them 90 days to get back to me to let me know that I didn't sign one specific section.
as soon as I receive that letter I signed it put it back in the mail and got it to them.. this was in July of this year and they've only gotten back to me today.

My question is is that if I do have to leave when do you think I'll be able to return?

So when you sent it back in July after yur status had expired, did you apply for Restoration?

No, you have almost no chance of being allowed entry. It appears you have been out of status for around 6 months.

I'm from Iranian and I'm planning to travel Canada and visit my aunt. my Visa was declined because of these reasons
  • I am not satisfied that you will leave Canada at the end of your stay as temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your travel history
  • I am not satisfied that you will leave Canada at the end of your stay as temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your purpose of visit
  • I am not satisfied that you will leave Canada at the end of your stay as temporary resident, based on the length of your proposed stay in Canada

My brief travel history are: traveled to Dubai, turkey (several times), Georgia, Armenia, Azerbaijan, Thailand .

My purpose of visit is to visit my aunt for one month in I have my own business in my country , I ll travel alone and my husband wont travel with me.I have no financial problem and sent all document about my company registration and tax payment , and bank statement and..


I am quite confused because I really don't see what's wrong. So i don't know what i should fix when i reapply.
Any help will be greatly appreciated.

It's too late to fix your status from within Canada. How easy it will be to return is a hard question for us to answer. Where are you from? What is your spouse's status in Canada? Do you happen to have a PR application in progress?

Ah, that makes sense. You submitted an "incomplete" application, giving you no "implied status". In the meantime, the clock on your status counted down to more than 90 days of no status. Sorry, but you are going to have to leave Canada. The error is yours, not IRCC's.
 
It's too late to fix your status from within Canada. How easy it will be to return is a hard question for us to answer. Where are you from? What is your spouse's status in Canada? Do you happen to have a PR application in progress?

I'm from the US... I've been married to my beautiful wife for 9 years... and we just had our 4th last year And now my PR application is not in progress

Is your wife Canadian? If so, why haven't you submitted a spousal sponsorship application yet? If you had, your situation now would likely be very different. Can you submit the sponsorship application asap (like this week)?
 
We never had the money to continue and when we do life gets in the way. But I just pulled all the paperwork I need to get the application started again. I just miss the 2017 tax returns. The plan is to get it done asap

Money for the application fee? Or is there a financial requirement?

so you had been in Canada for 9 years extending your stay?
 
Fee and other financial requirement in order for us to get this done.... and no I've been in Canada for about 2+ years prior to that we were living in the United States
