Hi All, please advise me on this matter. I am going to apply for a 6 month visitor visa and I want to know if it is possible to apply for a work permit when I am in Canada?

Thanks!

YES,

you can do it!

but it depends on a number of factors. Remember, you MUST have your HRSDC positive opinion. Unless your occupation doesn't require it, the HRSDC opinion is mandatory. Also you need the job offer and the supporting documents.

here you can find all you need:

Thanks guys,

Yes, that's what I read on CIC website and I think it's possible. So, I'll try to get 6 month visa first. Hopefully I will get it.

Regarding HRSDC opinion, I dont have much information about it. I know that the employer will have to apply for this but I dont know if it is difficult or not? Can a company easily hire a foreign accountant if they want to? Do you have any experience with that?

Thanks!

The application process is a pretty easy one. Basically, the employer has to demonstrate that he couldn't find a Canadian to do that job. It doesn't depend on the kind of job but on the fact that there aren't Canadians who can do it.

But the more you are specialized the more are the probabilities to get the position you are looking for.

The employer can apply on-line. Reply from immigration in 2-3 weeks, more or less.

good luck, Vietgirl.

Thanks Giancab,

That's the point that the employer has to demonstrate that he couldnt find any Canadian to fill the position. I am an accountant and for that kind of job, it's not so difficult to find someone in Canada, from my opinion. That's what I am worried about. Basically I got friend who owns a company and he could give me a job there, but how?

How?
Yours is the million dollar question and it's not an easy one. Your profession is not in shortage and even if you have friends who can -and want- help you they must demonstrate what you know very well. Your possible employer has to find the way to work it out but it is far away from being easy...

Have you thought to go there under a holiday visa? It's a six months visa that allows you to work. Basically they give you a kind of open work permit. Only, you have to be less than 35 and I'm not so sure you are still in time to apply for this year. Anyway it could be an opportunity to taste Canada. Canadians are used to saying: you never know. My suggestion is to give it a try.

You never know...

Hey,

I havent thought about the holiday visa yet. Anyway, according to CIC, if they grant me a 6 month visa then I could be qualify for applying a work permit form inside Canada:

Eligibility to apply from inside Canada

You can only apply for a work permit from inside Canada if:

* you have a valid study or work permit, or your spouse or parents have a study or work permit
* you have a work permit for one job but want to apply for a work permit for a different job
* you have a temporary resident permit that is valid for six months or more or
* you are in Canada because you have already applied for permanent residence from inside Canada. You will have to pass certain stages in the main application process before you can be eligible for a work permit.

I just want to know if I understand it correctly. That's why I posted it here.

BCguy, how do you understand this?

Thanks.

BCguy,

I was not presuming, it was just a suggestion. I know people from far East Asia who went to Canada with a holiday visa. It's up to vietgirl check if she is eligible or not.

About the eligibility for applying from inside Canada this is my story:
I was in Canada (Toronto) on July 2008 under a temporary visa. I got a job offer and then I went to the Saint Claire CIC office. The Officer told me that I could apply from both inside Canada or at the port of entry.

1) if you apply at the port of entry you have to go out of Canada and apply directly when you re-enter. For example, if you are in Toronto, you can exit at Niagara (border with US) and then re-enter, even immediately. When you re-enter you have to show the officer your stuff, including your LMO opinion, and if he is satisfied will give you the WP immediately.
2) if you apply from inside Canada, at the CIC office, expect to wait from 4 to 6 weeks to get your WP done.

I chose the first option.

Having a positive LMO is not enough as you have to satisfy the Officer with a number of other requirements.

but, vietgirl, the fundamental requisite to apply for a WP is having a job offer

Giancab, I appreciate your information.

Was your temporary resident visa a 6 months or less than 6 months?

For the job offer, does it have to be a certain kind of job or it could be any job? My concern is to get a positive LMO, as you know. And in my case, I feel like it's not so easy.
