Visiting In Canada Awaiting Spousal PR Status

Hello,

I've read through a few of the forums but I have some questions.

My fiance and I plan to get married in June. He is a US Citizen and I am a Canadian citizen. We will be raising some funds for him to come and stay and be supported without working for the time it takes for the application to process. We will not be married when he first enters the country.

I see that for some the process took 6 months if they applied within the States to a VISA office there. The Canadian customs website is currently showing an 11 month wait period for the applicaiton.

I know that he can visit for up to 6 months without it being illegal, but I am wondering about the extension of this and how problematic it can be if we're already married and he is already 'visiting' here? Is there anyone that has experienced a similar situation? I understand travel can be difficult but he intends to stay in Canada the whole time the application is being processed, if possible. Does anyone have any insight?

well i did not understand your post clearly but I will try and answer it based on how i understood it.

according to CIC website, it clearly state that **You can apply as a sponsor if your spouse, common-law or conjugal partner, or accompanying dependent children live with you in Canada, even if they do not have legal status in Canada**

your husband may choose to apply within canada or outside canada if he likes, but generally, application from outside canada are generally longer. He can also apply from outside canada even if he is going to be living with you in canada in other to take advantage of the faster processing period however, when he receive his permanent residence visa, he willl have to go out of Canada and re enter for the papers and stuff as a landed immigrant

Your spouse can visit to wait out the process while the file is processed in Buffalo, MANY US spouses of Canadians do so. The extension is not a problem either, so long as you provide adequate proof of his ability or yours to support him while he stays.

Obviously, when he is coming over, he should not bring everything including the kitchen sink, and should have some proof of ties to the US. Additionally, if you've already begun the sponsorship process, such as paying the fees, have that handy to show at the border.
