My husband and I got into domestic more than a week ago. He was charged with assault with weapon - spousal. Here's the tricky part of it all...he's not a permanent resident but has his work visa. What would be the possible outcome of all this for him as we are currently in the process of filing for him?

When filing for PR, he is criminally inadmissible if found guilty. If charges are against him his application will not proceed until charges are cleared. He needs a good immigration and criminal lawyer.

So our marriage will not be taken into consideration at all?
No. If found guilty of assault with a weapon (especially domestic violence) then he would be inadmissable under the Criminal Code. He may not even need to be found guilty. He needs a good lawyer.

Most important next step is to hire an excellent criminal attorney to try to get the charges dropped.
