Hi
I came here as temporary foreign worker in sep 2016. My visa was expiring in feb 2017, so I applied for visa extension which was granted until dec 2017. In the meantime 2 LMIA attempts by my prospective employer were declined. My visa also expired in dec 2017 but i applied for visa extension and another attempt for LMIA was made by same employer which was also declined and visitor visa extension was refused 2 months ago due to insufficient funds in my account. My lawyer at the time did not inform me of the decision. I just got to know about 3 days ago. Can I apply for study permit straight away? Can you please guide what can I do as I get in touch with lawyer at canada visa who said that First of all I had to get my status reinstated ASAP. I had already done Journeyman certificate last year. Please help?

When did you apply for the last work permit extension and when was it refused? When did you apply for the visitor visa extension and when was it refused?

At this point it may be possible to apply to restore your status or you may have no choice but to leave Canada. It's hard to say without more information.

I never got the work permit as it was a temporary foreign worker visa. Work permit was subject to LMIA. As per my part, I did my red seal in in 2015 and went back to Pakistan for 1 year. Then I came back in September 2016 and my prospective employer applied for LMIA. The visa was valid from 2014 to feb 2017. I applied for extension which was granted up till dec 2017 while LMIA was in process. I applied for extension again in dec 2017 which was refused in April 2018 due to insufficient funds but I was never told about it by my lawyer. I went to Local MP and he told me that it was refused in April. I did not receive the letter yet from my lawyer. Please tell me as I am very worried and in lot of tension. Thank you

Unfortunately it's not possible to say if you can apply for restoration without the refusal letter.

My strong recommendation would be for you to return home and apply for a study permit from there.

If you really want to remain in Canada, then you will need to apply to restore your status back to visitor. It may take several months for this application to be process. If it's accepted, then you can try applying for a study permit. If it's refused, you will need to go home.
