I'm currently pregnant and in the US ,I'm a PR and am planning to move to Canada .My husband has mood swings and can be very violent . He was the same at the time of my earlier pregnancy ,we were separated for 2 years, he begged forgiveness and I came back.But I don't think he has changed at all.
I'm wondering is there any help I can get in Canada, any support groups,do I at all have any rights there,I need some support atleast till the birth of my child.
What if I choose to deliver my child in India?
Any help is hugely appreciated .
 
There are womens shelters and support groups. If you deliver in India, you will have a problem getting the baby to Canada because as a PR, you must be in Canada to sponsor the baby but it can be hard to get a TRV for the baby to take it with you to Canada. You may face having to leave your baby with relatives in India while you go to Canada to sponsor.

Do you still meet the PR residency requirements? Do you still have valid health care in Canada? Do you have friends and family in Canada anywhere?

Since you have an older child, will you take this child with you to Canada? You have to make sure that you are legally in the right. You could face problems taking your child to Canada without your husbands permission.
 
Thanks Leon ,My PR is still valid( we landed in Canada on 10 jan 2010 and returned back to US).None of us have health cards or SIN as we did not apply at that time.I know it takes 3 months to get health card which will be difficult in my condition right now.
I understand from what you wrote that it might be a issue if the child is born outside Canada, but what about in the US ?
Hopefully things will cool down ...
 
Health care in Canada depends on which province you move to. If you move to BC or ON, you will have to wait 3 months. If you move to any other province, you will be covered right away. Quebec actually also has a 3 month waiting period but they waive it for pregnancy and childbirth.

If your baby is born in the US, you would have different problems than if it is born in India. I assume if it is born in India and the husband is not around, you could make it so that you have full custody of the baby and would be able to travel with it anywhere, however, the baby would need a visa to go to Canada. If the baby is born in the US, the baby will have a US passport and can go to Canada as a visitor without a visa allowing you to take it with you and start sponsorship once you are in Canada, however, your husband would have automatic rights to the baby so if he is unhappy with you leaving, he only needs to go to the US courts and accuse you of having kidnapped the baby without his knowledge and what happens then is that you will have a choice to either go back to the US with your baby or send the baby to the US and stay in Canada alone.

It is very important with children to make sure that you are legally within your rights. There are international treaties that deal with parental kidnapping so make sure you have full custody or that your husband agrees with your leaving before you go.
