Hello Members,

My uncle (my father's real brother) is living in Toronto, Canada with his family (a wife and 3 children) and they are all Canadian citizens. My uncle wants to sponsor my younger brother who is currently 17 but going to turn 18 very soon just after 1.5 months (this is why I mentioned urgent help needed) .

Pls tell me is it possible for my uncle to sponsor my younger brother? He has never sponsored anyone other than his wife and it happened atleast 10 years ago. Kindly let me know how can he sponsor my younger brother and what documents and processes need to be followed?

I was going through this link and it is mentioned there that nephew can be sponsored so is it a wrong link I have opened or am I reading something else?

If you read these instructions again carefully, you'll see that your uncle can only sponsor your brother if he had no wife, no children, his parents are no longer alive and he has no family in Canada.

Since your uncle has a wife and children, he cannot sponsor your brother.

Hope this helps. I know the CIC instructions can sometimes be confusing.

Both of my parents are still alive (by God's grace) even my grand father is also alive but he lives in our country not in Canada.

You can sponsor:

  • brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, under 18 years of age and not married or in a common-law relationship.
  • another relative of any age or relationship but only under specific conditions (see Note below)
  • accompanying relatives of the above (for example, spouse, partner and dependent children).


Note: you can sponsor one relative regardless of age or relationship only if you do not have a living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and you do not have any relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act.


Don't you think this note pertains to the line coloured in red? I mean doesn't it relate to "any other relative" who are not mentioned in the first bullet?

It clearly says in the note only if he has no other living relative, such as parents, who are also sponsorable. As your uncle's parents are still alive (your grandparents), he may not sponsor his nephew in preference to them.

Why don't your uncle help your brother out with a student visa? Most students eventually go on to acquire PR status if that's what you are ultimately looking at?

I was thinking about the ways of getting PR as it is better than student visa.

If your uncle is willing to move in Saskatchewan province and live there for at leat 1 year, then he will be entilled to sponsor nephew, cousin and uncle under Family stream. But here in Ontario...not anymore, otherwise your brother have to apply for student visa thru the help of your uncle.
