Usage of my sibling PR points who is visiting outside Canada - Help!

Hi Everyone,

Last month, I got the invite for my PR under CEC steam. In that, my CRS points included 15 points for my sister who is a Canadian PR. Because of covid, she got struck in India and could not come into Canada as a result she did not meet her 2 years residency requirement of PR as of now. She now lives here in Canada and plans to renew it. But her PR card on paper expires next month. Technically, she is still a PR.

Her family situation is really uncertain, so she left back to India for a while to take care of the deteriorating health of a family member. Since her situation is linked with my ITA, I have few questions before proceeding with my invitation.

1) Does she have to be in Canada at the time of submitting my PR invitation (ITA) application or can she still remain in India while I submit my application?

2) If she has to be in Canada at the time of submitting my application, I learnt that they might start revocation proceedings when she tries to enter Canada for the failure to meet the residency obligation. How can she overcome this ?

I am really confused now so I am wondering how can I proceed with my PR application submission. Thank you in advance for helping.

Don't claim the 15 points. If she's not living in Canada then you aren't entitled to the points. Hopefully you have enough points to be above the cut off without the 15 points. If not, I would decline ITA.

I also want to go through this with you on one scenario. Let's say in case if I proceed with the acceptance of ITA. I'm not sure I understand the question. You should not claim the 15 points. Your sister is currently outside of Canada, doesn't meet RO, and also doesn't have a valid PR card - which means she will have issues returning to Canada. I don't understand what you would try to explain in the letter. Your sister needs to be actively living in Canada in order for you to claim the points.
