Hi guys, I have read a lot of the posts and I have found them all to be very helpful but I do have some other questions that I have yet to see answered. I would most greatly appreciate some advice so thank you all in advance!!!!

I am being sponosored under the "Conjucal Partner" class of immigration. My partner and I have been together since June of 2008 and unfortunately we do not qualify under the "Common-Law Spouse" class because I was denied under the "Federal Skilled Worker Class" (mainly because I am 23yrs old and my skills are not up to the par for F.S.W).

Questions:
1. On the CIC website, it say that there is an average wait time of about 6 months (through Buffallo). My question is, does that include the 53 days (avg) it takes to be processed in Missagguaga? Does that also include the few weeks it takes for Quebec approve and attain my C.S.Q? Or is it 6 months avg when it finally reaches Buffallo?

2. I am still waiting for FBI clearance (which was sent on Jan. 29 2010) which is the only thing holding me from sending my portion of the paperwork. My question is, if I send my paperwork in the beginning of May and if I still haven't recieved an answer, can I go to Canada and try to live for 6months and wait it out there that way I can finally be with my beloved? Or do I need to stay here in NJ, USA for the duration?

3. How did you guys send your papers? Meaning, we're sending so much that it resembles a book. Would they accpet it if I did make it like a "book" in the sense I put it inside a binder with a table of contents with each page covered by clear medium weight sheet protectors? If not, any advice?

4. Also, did you guys need to get any paperwork notorizied? If so, which ones?

5. Do I need to send them my birth certificate?

6. I already did my medical exam on April 2 and I marked on the form that I'd like the results to be transferred to Buffalo. Question: How do they know to hold the results if I still haven't sent my papers? Do they save it and find it when they finally do recieve my papers?

7. Also, my sponsor/conjugical sponsor is still married but she has been seperated from her husband since the spring of 2008; Question: She filed this year and last year's taxes as "single" meaning she didn't mention that she was married, is that enough to show that she is seperated? If not, what more do we need to prove that she and her husband are seperated?

8. I was denied under Federal Skilled Worker class because I lacked enough job experience to qualify. The reason why we didn't go down the sponsorship route is because I wanted to show my sponsor that I am willing to try alone first. Question: Will we encounter more challenges because I was already denied?

9. Any advice on things to add to the portfolio to help prove that our relationship is real, as long as we
testify it is and still on going? We think we've thought of enough but it doesn't help to get a few more ideas.

You guys, thank you so very, very much for all your help and time. I know I just asked a lot of questions
but we've been together for a long while and we just want to finally live our lives together, to be able to hold eachother and not have to stare through a laptop through web cam.

Conjugal parter is really hard to optain... You need to proof to immigration officer that you CANNOT be married or be in a conjugal partership... this category is more use for people of the same sex or people that get married before in the country, and this country not autorising divorce.

If you husband still not get is divorce from previous marriage it will never past the sponsor eligibility, i need to proove a couple divorce paper to the immigration.

Well....i think that for inmigration your partner need to be legally divorce to get approve like a sponsor. Been separated is not enough, she's legally married. They will ask for the divorce papers. My advice for you is to talk with your partner to see if she can finalize with the divorce process first.

Look around on the boards and you will see how many people have been denied conjucal partner sponsorship. This is the hardest class to get into. CIC doesn't care if you can't afford it, if she's not divorced so you can't get married, etc. This is an almost impossible thing to do if you are in a visa except country (like the USA) because, in their eyes, nothing is stopping you from going to Canada tomorrow and being with her. They don't really care if you can't afford it, if you can't find a job, etc. You will probably do better either to A--Wait until her divorce is through and get married or B--Enter Canada as a visitor for 6 months, extend your status and live together for a year so you can apply under common law. Option B can be tricky also; if you don't prove sufficient ties to the US, they won't allow you in.
