US Citizen Reentering Canada while outland PR in progress

Hi all,
My husband and I got married March 7, 2013-him Canadian (staying in Canada) and myself a US Citizen.... Anyhow, we sent in our spousal sponsorship May 28th, Outland. I was staying with him in Canada from January 1, 2013-June 12, 2013. My visitor visa expired June 30th (still unsure why the woman felt the need to give me one). I am hoping, God willing, that I will be able to re-enter Canada this next Sunday, June 23rd. I have a massive copy of our application. But will this be sufficient enough? I really don't have many ties to the US anymore being that we have been making our lives work together off of his income solely. I'm beside myself with nervousness, already missing him like crazy!

The sponsor approval letter would be better than the application (IMO). I can't see you having any issues, loads of people do it. Although, entry in not guaranteed.

Have a copy of your marriage license and your sponsorship approval letter if you have it. Be sure to tell the truth about your intentions. From our experience this is the best policy. We were advised to say that my spouse was just visiting and the immigration officer said point blank to us that he knew we had probably been advised to say this but in truth was it the intention of my spouse to reside in Canada. Would he find our application for PR in the system. We said that this was the case and he said then just say that. He gave my spouse a 1 year visitors record which took us through the entire process. The only catch is that the VR is not necessarily a guarantee that if you leave again you will be allowed to return to Canada.

Good luck on your return to Canada. Can you post an update to let us know what you did and what documents you used and whether you were granted a one year visa.

Hey mm magic, FYI all went well... I was fortunate enough to receive a one year visitor visa. I just told them that I had a PR application in process-they didn't ask to see documentation. in my mimd, I think it went so well because I just finished RN school (the reason I went home) and they seemed to like this... Went amazingly smooth though. They were even cracking jokes about the immigration officer I dealt with upon entering last time...

Thanks for the update. Can I ask whether you arrvied by air or land? Did you tell the immigration officer of your intent to stay in Canada while waiting for the PR application to be approved; and requested a year visitor visa?

I'm getting married in october and filing as soon as I change my name and get new identification but here is the issue, we are staying with his parents in Quebec until we find a place in Ontario so I will have my application, all except that info. I have no intention of staying in Quebec nor filing a CSQ. So what should I tell them? I obviously want to stay with my husband throughout the process.

A bit of a related question here.

what would you suggest in my case for my wife? My details:

-got married in October 2012
-send in application to sponsor my wife in January 2013
-sponsor approved in Feb
-would like to visit me in July for a long stretch of time

In her mind, she is looking at the visit as almost a pre-move since she quit her job and just wants to spend time with me while the application is in process and she will bring a bunch her clothes, misc with her. But she still will keep her current place of residence in the US, her car, phone, etc. She also plans on going back and forth between the US<->Canada to spend time with her family in the US (though the bulk of her time would be with me in Canada). So I think she legitimately really just visiting and should just say so (she will have definite plans of leaving, including a return ticket each time). I'm wondering if boarder officials would be bothered by the fact that she is coming and going often though (maybe once a month) and that she is trying to visit Canada again after leaving just a few days before.

She also visited me in February this year with no problem. She just said she is visiting me for a week (yes, she did leave after a week). She did say they asked her a lot of questions when they found out she is married, but otherwise let her through.

If you get in again you could always apply online to extend your visa and request a year. Worst case you get denied but you would be under implied status. They might give you 6 months vs a year on the extension if you ask for a year.
