I am a Canadian citizen previously divorced in Bangladesh. I followed the required law, filing the Divorce notice and since my ex-wife did not contest the divorce notice after 90 days a divorce certificate was issued. After few years I remarried in Bangladesh and with the spousal sponsorship application I sent the divorce certificate ( as plainly requested in the sponsors checklist).

After more than 1 year of sitting on my wife's spousal sponsorship, CIC has now sent me a request to send them within 30 days a Divorce Decree.

However in Bangladesh no Divorce Decree is issued unless divorce is contested in court.

I spoke with a Canadian lawyer and he suggested I should get the divorce reviewed by a lawyer in Dhaka and get a "Legal Opinion Letter" on the validity of the divorce certificate. The Canadian lawyer will then write another "Legal Opinion Letter" based on the one he gets from the lawyer in Dhaka. I got some lawyers information online and I have already spent 6 days going back and forth with these lawyers. Not one of them has prior experience writing a "Legal Opinion Letter" for CIC.

Is there a better option?

If there is no better option, I need to get a hold of a good family lawyer / law firm in Dhaka that can assist.

Please suggest your thoughts and advise. Thanks!

Before trying to do anything with the lawyers, simply reply to CIC's request with a copy of the divorce certificate and an explanation of the law that there is no decree for uncontested divorces and so it is impossible for you to obtain one.

If you could cite the law, that would help as well.

In case someone else has a similar dilemma I am updating the post.

I got a local family lawyer to write a legal opinion letter and provided the letter with the additional divorce documents. The lawyer is Barrister Sajib Mahmood with Counsel Law, Dhaka. He was very professional and understood what was required. His cost was very reasonable and most importantly I found him to be honest and sincere in the advise he provided. ( another lawyer added extraneous paperwork and doubled the total fee) . Mr. Mahmood's contact can be found with a online search.

I sent the additional requested documents in the first week of August 2016. My wife received her passport request this week. Therefore I can assume the CIC officer was satisfied with our response.
