Urgent Visitor Visa from Inside Canada

Hello all!

I hope you are having a wonderful Saturday evening! I am currently in Canada on my sixth year, on a work permit which expires on March 6, 2015.
I have been given a new job offer from an employer who has applied for an LMIA this week.

However, the processing time for Work Permits is about 43 days. Here is my question...

Question:
My sister is to be married in India on April 8 2015 and I would like to visit her for her wedding. I would like to return subsequently in May, when the LMIA is expected to be approved.

My Options:
However, to return I would ned a multiple entry visa. Since the timeline for a work visa is 43 days I wanted to know if there is an urgent processing option so I can go to India on it an return.

My second option is to go back to India and apply for a visitor visa from there, which I would like to avoid. I have always been given visas and I would like to know from your experience what the best option is for me.

1. There is no "urgent" processing for TRVs. Plus with only valid status until 06/03/15 they won't issue a new TRV in Canada.
2. You are going to have to apply overseas and again you would have to apply for the work permit as well, since you would no longer have status in Canada.
3. You say you have worked in Canada for 6 years, are you still eligible according to the 4 year rule? http://www.cic.gc.ca/english/work/apply-who-eligible/four-year-maximum.asp?s=1

Hi PMM,

Thank you for your response. I've been here all the while in NOC code 0 or A so yes I am eligible. I have also previously applied in 2010 and received an extension on an urgent basis from the CIC while waiting on a work permit.

VISITOR EXTENSION:
I will apply once again, with the hope that they will process my application with urgency. I have sufficient funds i.e. over 3K per month for the next 6 months for my stay here.
Also I own 50% of the company that I has applied for my LMIA so this should prove my intention to stay in Canada. They are applying to bring me on board as a Permanent Resident.

Your thoughts?

There is no point applying for a visitor extension if you are going to be leaving Canada. As soon as you leave Canada this cancels your extension. The extension is only valid as long as you remain in Canada.

Make sure you are not mixing terms. You didn't mention a Visitor Extension in the first post and you didn't follow up on a TRV in your answer.

BTW, if you already know how to get an "urgent processing" why do you ask? Follow the same steps... (that's what I would do, no rules have not changed).

I am looking for a TRV so a multiple entry visa to be stamped on the passport that will allow me a re-entry. As you can understand, a wedding is a special occasion and I would like to do whats necessary to be there. The funds are not an issue.

It takes 45 days, and that is why I inquire on anyone else that may have received success, as I did in 2009.
I am also considering sending the passport directly to India where the total timeframe is 7 days. The Indian Passports Act does not prohibit this.

I appreciate your responses.

The Indian Passports Act prohibits anyone from sending their passports outside the country of residence by courier, post, etc

b. Which visa office in India are you referring to?

In that case you need to apply for a new TRV - NOT a TRV extension.

Thank you for clarifying Scylla, yes I will apply for a new TRV. As per the CIC website I am allowed to apply for a TRV as long as I do it before the current permit expires. Since the total timeframe is well within the 1 month I need to visit India for the wedding I hope things will work to my advantage.

I look forward to hearing your thoughts on the same.

Bryanna, thanks for your input, as far as I have read, the Indian passport act does not prohibit sending it to Canada. I hope you're able to quote the relevant section if this is in conflict with the rules

Perhaps, you are not familiar with the Indian Passport Act of 1967, nor with the sections and the restrictions therein in The Passport Rules, 1980.

Can you quote ad verbatim the relevant sections... if at all you are able to find such a section under the Indian Passport Act, 1967.... which states that a passport issued by the Government of India can be freely sent out of the country of residence by courier, post, etc. while the passport holder continues to reside in another country?


as far as I have read, the Indian passport act does not prohibit sending it to Canada.
Can you please let us know which section of the Indian Passport Act, 1967 allows sending Indian passports to Canada, in particular, without being in the possession of the passport holder?


Also, you have probably missed reading it or you have forgotten what you read when you filled the basic application form for an Indian passport. Do read it up again

On the contrary, your "request for help" comes across as wanting to bend/break Indian Passport Law and Rules despite being cautioned.... and yes, cheeky.

You are unable to quote the section(s) of the Indian Passport Act, 1967 nor the sections under Indian Passport Rules, 1980 which state that Indian passports can be sent to Canada, in particular.... as per what you have written in your previous post

Do a simple Google search if you still believe that Indian passports can be sent freely out of the country by courier, post, etc
