[Urgent] Study permit help

Hi everyone,

[Background] My old study permit in Canada expired on March 31, 2022. At that time, I was waiting for a decision from my new institution, so I applied for a Visitor record before the deadline of March 31. I then applied for study permit early in June from inside Canada, after I receive the Letter of Acceptance. In my application package, there was a form of IMM 5709e: "Application to change conditions, extend my stay or remain in Canada as a student.”

I have not received a decision regarding the Visitor Record. Yesterday, I received a refusal letter for my study permit application, stating that I can't apply to extend my student status because I applied after my old Study permit expiration date (it expired on March 31 & my study permit application was in June). It also says I can apply for restoration of status within 90 days of my expiration date, but it has passed 90 days now.

Initially, the immigration staff at my institution told me to apply for new study permit from inside Canada, but it seems that all applications from inside Canada are supposed to be extension only? When I applied for Study permit in June, I did not have a formal status in Canada except for maybe temporary status due to my ongoing Visitor record application. The staff told me I could just put Visitor status when I apply. Maybe the IRCC agent doesn't recognize my status of applying for Visitor record?

I am currently in Canada and I don't want to leave just to come back a few months later. I don't think that there is enough time for Study Permit application outside of Canada either. The processing time is 12 weeks now and my study starts this September.

What should I do to receive a Study permit?

I dont think there are any other options, officer was right. you applied to extend your study permit while it was expired.. your SP expired in March and you applied in June with IMM 5709e. In your case, you dont have status now despite applying for visitors visa ( There is no maintained status) in this case. To avoid overstay, You need to leave and apply for new study permit after your new institution gives you LoA.

Hi, I applied for Visitor Visa even before applying for Study permit. I applied for it a few days before my old Study Permit expired. They have refused my Study Permit but are still processing my Visitor Record application. Since I applied before expiration deadline, I should be able to stay in Canada until they have a decision on my Visitor record application?

Also, I have the LoA now. Can I apply for SP outside of Canada online, while still remaining in Canada waiting for Visitor record, and then go to Port of Entry (PoE) to receive the study permit when it is issued?

You can't apply for new study permit in Canada because you are not eligible. Your best bet right now is to leave and reapply.

No, applying for visitors visa before expiry of your study permit doesnt give you implied status. second question the answer is no....you need to leave Canada and apply outside of Canada. You currently dont have status...
