Urgent PLS - Confused and Stuck between FSW, CEC and my JOB

Hope you'll are doing great.
I need some urgent advise from yourselves. I am stuck between a hard place in a rock (thats what i feel)

Here's the thing,
2010 Jan - I arrived in Canada as a student for a 1 year PG program
2011 Feb - I acquired a 1 year open work permit and got a job at a bank.
2012 March till present - I got a new employer who gave me an LMO for 2 years to work for him.

All sounds good but here is the sour part....
-My boss is a nice person but his partner is perpetually an unhappy miserable man and has been giving me a tough time since the 2nd month of me joining my job. I am so mentally stressed out that I feel suicidal sometimes but nevertheless I tolerate the nonsense and live with it.
-My 6 month probation is nearing an end in September, but i do now know if i will be kept or let go off my job.
-Either way I want to play safe here. By Jan 2013 i become eligible under the new CEC rules.
-Right now I am thinking of appying in FSW since I have an offer letter.

My questions are:-
Q1 - What if i apply under the federal skilled category and after that lose my job? What happens to me and my application?
Q2 - What if i lose my job soon before applying under FSW. Can I still stay in the country until Jan 2013 and file my PR under CEC, what are my options?
Q3 - Is it possible to apply under the new CEC rule now itself and wait for the file to open (which is ideally 4 months, until then it would have been JAN 2013) ?

People, any sort of help, advise and TIPS would be highly appreciated and would help save hope for me ... I have struggled way too much to be in Canada and would not want to leave to go back to my country for good.

If your job offer is withdrawn, your application would be refused under current rules. However, you may remain in Canada to the end of your work permit, giving you time to find a new position (as well as collect any EI to which you are entitled). A new job will require a new LMO and a new work permit, of course. If you are not employed, you will not be accumulating the time required by CEC, so even though you can stay, you won't be able to apply without the required work experience.

Well for CEC the new rule says only 12 months experience right. I have a good 12 months experience prior to my current job ... I worked 1 year already at TD Waterhouse + 1 year post grad education at GBC. So doesnt that automatically qualify me for the new CEC rule? I'm confused now .

As for staying in Canada till the end of my work permit inspite of not having a job, is this viable. I mean to say is this good info and likely a positive one. Do you know or have you heard of someone doing this before?

If you already have sufficient time under the CEC rules (or the new CEC rules) then yes, you can apply. I know the rules have been changing here and I'm not following CEC terribly closely, to be honest.

Viable? Only YOU can tell if you can afford to stay here. But if you are terminated, you will have EI for some time. I do know people who have remained in Canada after their original employment has been terminated (and in that case they also had a PR application in process). It is definitely allowed under the current laws. Further, keep in mind that as a TFW you have essentially all the same legal rights as residents working as well.

My personal opinion is that you should either find a new job, or confront them at your current job and explain your dissatisfaction. They might terminate you as a result of it, but in that case you'll have EI and the ability to go look elsewhere. Alternatively, it might improve the situation - sometimes people do not realize the impact their actions are having upon others. Sometimes they do and just don't care.

When you are eligible for CEC (or any other PR category), by all means, send in an application. I'd start preparing materials 3-6 months in advance of the actual date when you can file it. Some things don't go stale (university transcripts) and some things do (IELTS, PCC, etc) so try to time them accordingly.

Good luck - you DO have options, so the most important thing is to keep that in mind and your stress levels will be lower.

Computer Geek you have no idea how relieved I am with your advise. I have been lost since months with stress, tension, unhappiness and discontent. But thanks for lettin me kknow that there are many options to live on here and that i do not need to go back for good.. cos that would be an utter miserable stance for me.
