Hi, I am an 24 year old female who is an American Citizen married to an Canadian Citizen. I am currently residing in Winnipeg, Manitoba with my husband and my application to become a permanent resident has been in process for over a year now. They are making us redo a lot of paperwork some they have lost. But meanwhile I wanted to know if I am able to attend school on my visitors visa. I am currently in the process of applying for another extension and I did attend school for 6 months already last year. But If the School is free and will let me attend does that mean I am being authorized to do so? And do I have to inform Canadian Immigration? If i don't inform them how will they find out? Thanx so much.

And by the way I am trying to get my Mature student diploma in other words HS credits at a community college funded by the gov.

You can study in Canada without a study permit if:

  • the duration of your course or program of study is six months or less; and
  • you will complete your course or studies within the time you are allowed to stay in Canada

But It depends on you to finish it can be 6 months or more. So what if the school allows me to attend and I dont have a study permit? And my extension is up July 7 and I applied for a new one yesterday.

Your program length should be 6 months long or less then you are allow to study without any permit.
This would not be acceptable by CIC that your program is i.e 1-year long and you keep studying in it on your visitor visa. This is illegal, regardless of what your institute say...

So what if i attened school for 6 months already should I stop? and if so how would they know If i ever continued? is it on record?

At the end of your schooling, you will be issued a degree or diploma of some sort I assume

If CIC finds out that you violated the conditions of your SP, you can say bye-bye to any future immigration benefits in Canada

I need 8 credits to recieve a mature student diploma. 2 months a course i already recieved 4 credits meaning i attended for 6 months last yr already. Should i stop going until i become a permanent resident and then graduate?

You are a visitor in Canada---according to the conditions of your visit visa you need a study permit to study for more than 6 Months. Studying for more than 6 months is a violation of your visitor status.

No one can answer your question because no one can predict what will happen if you go back. CIC may or may not find out and even if they find out, they may or may not do something about it. It is a risk to go back to school, but it is your decision if it is a risk you want to take or not

My credits are good for 3 years so im hoping my paperwork gets approved by then. have you ever heard of anyone going back to their country because they attended school for more then 6 months as a visitor? and also am i still considered a visitor even if my permanent residency paperwork is in process? and also willl they have any reason to deny my third extension.? thanx

Why don't you apply for a Study Permit while waiting for your Permanent Residence? As a spouse of a Canadian citizen you are eligible to apply for a Study Permit from within Canada. You can apply online and receive your Study Permit in a very short period of time (a week or two). When I had a foreign worker status my husband changed his status from visitor to student while being in Canada. You just need to attach some extra documents like your marriage certificate and proof of your husband's status in Canada (his passport will do). Your case is not complicated. I hope you know that as a spouse of a Canadian citizen, you are exempt from international premiums and should pay domestic fees. All the best!

Thank you so much for your reply. I am going to apply for a study permit but its the money. I have to redo my medical because they lost it thats 250 and 100 for my extension today. They want extra proof on our marriage etc. next week hopefully I can apply for a study permit but until then I will not attend school because I did attend 6 months already. I sent out my paperwork late 2012 early 2013 and its been over a yr now and Im still dealing with them.

i believe that you can do multiple 6 month courses (one after another) but not single course for more duration. (i am not sure about this)

when you enter canada as a visitor, you can stay in Canada for max 6 months usually (http://www.canadainternational.gc.ca/china-chine/visas/shanghai/faq.aspx?lang=eng#t1)

so you need to leave canada after your six months are over. so while you are in canada and your visitor visa has not expired and you have been in canada about 1 day ago, then you have about 6 months to do anything you want, study, travel, etc.

but if you study is more than 6 months long, then you can only enroll in an institution if you have study permit.

but if you decide to violate the rules and apply to program which is more than 6 months long and doing all this on visitor visa, then your school/college will ask you to provide them the copy of your permit. you will not have that and then school will cancel your admission and report to police and border force. police will take you into custody and deport you.

now, lets assume you have been deported and you are sitting in your home waiting for your PR to enter canada. here is the catch: in all these immigration you are not really given PR right away. actually, you are just given an approval letter. using this letter you need to secure visa from embassy to enter CANADA. PR is only applied after you enter Canada. you cannot just enter Canada on the basis of approval letter, you need a VISA.

so, here is the proble: you are given an approval letter for your immigration application, you take this letter to embassy to get your visa but embassy already knows that you were once deported for violating the laws. now, that embassy based visa officer can and has the right to deny you will on the basis of your criminal record. (remember that deportation)

So, my very important suggestion to you is that don't violate their laws, it will make you criminal in the eyes of the law and it can negatively effect your PR chances.

lets say that you still do all that anyway and you still want PR. you need a very good lawyer who will file suit against VO if you are denied visa. still your chances of winning the suit will be 5% max. and it is gonna cost you buttload of money.
