I arrived in Canada in 2003 as a student. I was a full-time student till 2008 and graduated in July 2008 with a bachelors degree. Currently, I hold a post graduation work permit. I have lived in Canada for almost 8 years.

I have applied for Permanent Residence under Canadian Experience Class in July 2010 and am awaiting a decision. My application was transferred by CIC from Buffalo, NY to The Canadian Consulate General in New York, NY to expedite the process on April 12/2011.

I had also applied to renew my current work permit in order to keep my documentation valid and be able to continue my employment till I receive a decision regarding my permanent residence application. My current work permit expired on May 14/2011.
I just received a letter saying they have refused my work permit renewal due to lack of LMO and confirmation from HRSDC.

My work permit has expired now.. what do I do??? Do i apply for restoration/renewal?? I am not sure if my employer is willing to give me a LMO since it's a contract position. The company I work for wants to hire me on full time soon. I have rent, car payments, bills etc etc. Do I have to quit my job if I can't get an LMO??

PLEASE ADVICE!! NEED HELP!

The second you received this letter, you are officially out of status and no longer authorized to work. You have to stop working immediately.

This makes no sense - they want to hire you full time but are not willing to apply for a (FREE) LMO? If you haven't even asked, bad on you.

You have to stop working NOW. As for your rent, car payments, etc - I sympathize, but its your own responsibility if you did not ask your employer to apply for an LMO before your work permit expired.

Not sure what to tell you, there's no way of knowing how long it will take to complete your PR.

You might want to go see an immigration lawyer.

You can apply for restoration of status and change of status to visitor, but you CANNOT work.

You can try again for the work permit (Need an LMO), but you do not have "implied status" any more - you cannot work.

Suggest you ask your employer for a leave of absence and go "home" until you receive your PR visa. It may not be that long. But if you remain in Canada without authorization, if you work without authorization, you might jeopardize your PR application.
