Hello,

I have been here in Canada since September, as an exchange student for a study duration of 6 months ( 1 year ).

However, on my study permit I have these remarks :

1) Unless authorized, prohibited from engaging in employment in Canada.

2)May accept employment on or off campus if meeting eligibility criteria as per R186(f), (v) or (w). Must cease working if no longer meeting these criteria

So, I went to CIC in Montréal and got my SIN, which expires the same time my study permit expires.

And now I am working Off-campus !

Am I doing something wrong here???

If I am not allowed to work because I am an exchange student, how did I get SIN number?

Why it is written on my study permit that I can work on or off campus?

Okay I have read more and understood that even if I have my study permit that allows me to work, since in the R186F(v), my studying year here doesn't lead to a certificate or diploma, I can not work off campus.

but I have already worked.. I don't know what to do !!

only thing I can tell would get paid in Cash.
otherwise, you would have record (tax) of pay stub etc.

It's illegal for you to work off campus. If you have already worked off campus, then you have violated the terms of your study permit which means your study permit could be canceled at any time and you could be asked to leave Canada.

If you are still working off campus, you need to stop immediately. It is your responsibility to understand the terms of your study permit and follow the rules.

If you were planning on applying to extend your stay in Canada once your study permit is finished, the illegal off campus work may impact your ability to be approved for a longer stay.

I quitted the job today, but I wanna know how the government would know that I worked? According to my bank or what?

If you have been paid few times then you would have a record at CRA
You have to claim tax next year.

if CIC would request your notice of assessment /option c print, then it would tell.
Also, if CBSA / a question on the form while applying for any kind of visa would ask if you have been working without a permit, you have to say yes. (no proof at that time, but you should give honest answer).

hope other members would give more info.

whether you would get paid once , it would have record.

I meant if you apply for PR near future etc.
normally CIC would not request it for study permit.

Okay so now is there a risk that I get deported from Canada ? I mean can police officers come to my appartment and be like you worked illegaly you have to leave or what ?

And what is this request in general ? Like I have to explain why I did such an act or what?

And for the PR , it means i will never get it ?

unlikely to happen unless someone calls CBSA and tells them you were working illegally.
The issue will most likely arise if you apply for permanent residency, which is when you are asked to disclose your tax information. or applying for a new permit which will ask you to disclose if you have worked illegally before

Also if you get asked for whatever reason, you must say the truth, otherwise it would be misrepresentation and you would be banned from Canada.

I agree it's unlikely anyone will show up at your door.

Where you may run into a problem is when you try to extend your stay in Canada or apply for a work permit / temporary resident permit.

But it's really impossible for any of us to say what will happen.

Okay and is there a way to overcome this in the future to avoid any negative answer? Like will they allow me to explain the situation ?

It's already done. Nothing you can really do about it at this point. CIC will either overlook the illegal work when they issue your next visa or they won't.

Okay one last question, I took an appointment with a lawyer to discuss the issue and it is going to cost me alot..

Do you really think it worth it ? I mean would the lawyer do something for me now to remove the issue from my background ? Or there is nothing to do about it ?

and when I apply for the PR or any other visa, will I have to explain the issue or will CIC request me to justify the action I did, or no ?

No - I don't think it's worth it to meet with a lawyer. No - a lawyer cannot remove this issue from your background or do anything about it.

Yes - when you apply for future visas you should explain why you worked illegally.
