Hi,

I need urgent assistance with my sister’s visa case. She is 28, a veterinarian in Iran with a combined 7-year bachelor's and PhD degree, multiple publications, and notable achievements in her field.

Here’s her visa history:

  1. First and second attempts: She applied to visit me in Canada, where I’ve lived for 3.5 years, completed graduate studies, and now work. Her applications were refused due to financial concerns and lack of ties to return, though my parents were granted visas during the Iranian Support Visa initiative.
  2. Third attempt: She was admitted to the University of Guelph for a master’s in Animal Biosciences. We hired a reputable immigration lawyer, submitted a comprehensive application, and emphasized her intention to return to Iran after studies. IRCC requested her resume and an interview, but two days later, the application was refused again, citing doubts about her return.
We are deeply frustrated with the repeated refusals despite presenting a strong, well-documented case. What can we do next to overcome this unfair outcome?

I am guessing the issue with the study permit may have been that she was planning to take a lower level of study in Canada than she has already achieved. Another PhD would have made more sense.

So if she has a PhD, then she needs to take another PhD. She is a veterinarian so no reason to take Masters in Animal Biosciences. Program makes no sense and rightly refused. Why does she need to study in Canada at all if already a vet? How would she justify costs because she cannot show education progression so how much more will she be making when she returns then she does now. Does she even plan to return? What family ties does she have to return to? Or will she just apply for work permit under special measures like your parents? She had an interview so IRCC knows she has no intention of leaving Canada.

The fact that your parents have applied and received the OWP for H&C likely leads to concerns that your sister will do the same and is not a genuine visitor. Assume family ties may also be stronger in Canada than to Iran. The multiple applications also create concerns that she is trying to get to Canada by any means possible. Her best option is likely to gain some job experience and apply for economic immigration .
