Hello Guys,

I am asking this question on behalf of my friend.

So the Scenario is:
He applied for the PR through EE, he got 600 LMIA points that time then after 3 months he lost that job but he didnt inform cic and he started work somewhere else. Recently, when he applied online for BOWP, he accidently mentioned in that about his new job.
Will this be considered as MISREPRESENTATION? and if yes, what are the solutions?
 
I'd be more concerned that from what you have mentioned he is working for an employer without a proper work permit in place to do so.

What permit was he on when he changed jobs?
 
I'm confused - he had an LMIA supported permit in January and then in April he got an open permit but he already needs to apply for a BOWP? Seems strange.

Either way, yes he should have mentioned the loss of the job which gave him the 600 points to CIC and they may or may not pick up on it from his BOWP application.

He is on PGWP(2013-2016)
He got LMIA just to get 600 points.

People doing things like this are why everyone needs to jump through hoops to get PR. There are legitimate people applying for LMIA that are declined regularly, your friend being lucky enough to get one but with no intention of doing the job is not right in my opinion. The LMIA system is flawed and this kind of thing highlights that.

However, onto the matter at hand - it states on his AOR for PR that a loss of job offer (LMIA supported job) must be reported to CIC. He has not and if found out, yes this would be misrepresentation and a 5 year minimum ban.

Let's see... your friend accidentally told the truth, and is worried about misrepresentation? Hmmm...

Lying or hiding the truth is misrepresentation. Telling the truth is not. In any case, the fact is that your friend no longer has a valid job offer and because of this, the PR application will be refused. Cannot predict whether a VO will catch it when reviewing the BOWP application or later, but the BOWP could be refused as well...

Do you know if the VO who process the PR application and BOWP, is the same person?
 
It shouldn't matter if it is the same officer or not. You have one file and everything you do is recorded (request GCMS notes).

No, they are not the same people, but it is one integrated information system (GCMS).
 
His Background is already in progress since last week and we are expecting PPR soon.
Can anyone give a brief info about how Background progress thing works?

You are expecting a PPR? Really, why? You know he is no longer eligible. Although VOs do sometimes make errors in favor of applicants, it is rare. He should be preparing to re-apply.
