My dad (Indian passport) visited Washigton DC from Shanghai last month. He travlled through Air Canada and didn't apply for a transit visa. No one asked any questions. Now today he is going back and they didn't allow him to board the flight in DC as he had no transit visa.

Now my question is how fast can he get a transit visa and what's the best way to approach this to get an emergency transit visa. If he can't get the visa in a few days, his only other option is to book a different flight. Now what are my chances to fight Air Canada to get some compensation for all this (on the basis that why did they allow him to board the flight in the first place in Shanghai). Please advise

Thanks

It looks like Air Canada made a mistake allowing your father to board the flight from Shanghai to the US. He needed a transit visa to transit through Canada. Chinese nationals are exempt from this requirement. My guess is that someone make a mistake and treated him as a transit visa exempt Chinese national rather than an Indian passport holder.

I don't believe there is an emergency process for applying for a transit visa. He'll have to apply the regular way and hope the visa is processed quickly.

Air Canada will not compensate your father since it was his responsibility to make sure he had the right visa to board the plane and travel.

For any kind of urgent/emergency processing you have to be able to show that in fact it is an emergency. As far as I can tell there is no emergency, just bad planning. This does not qualify.

Air Canada has no responsibility in this. It is our sole responsibility to have all the proper documentation for our own travels.
