*URG* Need advise- LMIA exempt WP

I have a situation below:

Current WP (open) expires: Feb'17 | PGWP (1 yr)
PNP Nomination holder: SINP - Employer restricted (expired)
PR application: Paper application - PNP stream- AOR received- RPRF paid in last communication from CIC

I applied for a BOWP which was refused as I didnt know that applicants with restricted PNC cannot apply BOWP.

I am in process of applying new WP- closed this time.

The problem is that I have changed employer since my nomination.

My PNP Certificate (currently expired) shows employer 1

I have a Full time job offer form employer 2 now and my new employer has paid $230 compliance fee as well.

Need advise if CIC will entertain this closed WP request. I am currently waiting on decision on my PR application and my current WP is expiring.

I am looking @ http://www.cic.gc.ca/english/resources/tools/temp/work/opinion/territories-provinces.asp

Not sure how to get 'statement from the province'

Any suggestions/opinions welcome

Oh boy....did you inform SINP that you changed employer? You said your nomination is employment restricted right? That means you have to stick to that employer til you got your PR. Now you have to inform SINP and they will have to reassess your new employer and hopefully you'll get a amended nomination.

No SINP was not informed of this change as the PNC or WP support letter did not mention anywhere that change of employment should be reported.
Also, I called CIC to see if I can change jobs and they said as my current WP (PGWP) is an open WP so it shouldnt matter.


Also, at the time of applying to CIC (PR), I was still working at my old work (employer 1). Do you think it will be a factor in CIC processing? Does changing jobs on restricted PNP deems the certificate null n void? Any documentation/links to support this? Help appreciated.

Labour Market Impact Assessment exemption - Provincial nominee

Generally, if you want to apply for a work permit, you need a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada and a job offer letter from your future employer.

As an exception, you can apply for a work permit in Canada without a LMIA if you are a provincial nominee and if you have* a:

Letter from the provincial government (with a certificate number) confirming that you were nominated for permanent residence by the province,
Job offer from an employer based in that province, and
Statement from the province that it has determined that all factors required for the issuance of a work permit as per its agreement with Canada have been met, and identifying the occupation and employer information.
It is not necessary that your application for permanent residence be received by CIC for the work permit to be issued without a LMIA.

Quebec-selected skilled workers are not part of that category.

The part is red is what I am confused about, does this imply a revised letter of support with new employer from SINP?

Letter of support comes from SINP along with your nomination letter. It will say something like you need to start working with_________. That part will list your employers company. Therefore you must inform SINP that you switch employer and they will reasses you and your new employer to see if you'll still qualify under the same category that you applied under.
