Hello all,

I am trying to help out my sister and need some guidance.

1.) PR Application was filed on 14th Jan 2020. Marriage was solemnised on 18th Jan 2020. Till date not intimated to CIC as legal document of marriage is not available. Could not be obtained as immediately travelled abroad and since then stuck owing to Covid outside country of domicile. Do we need to update through email to CIC about marriage without having legal certificate, during the processing period of PR application. We have marriage certificate issued by religious institute where the marriage was solemnised.

2.)If the information about Marriage is shared with CIC now during processing period and after 4 months of marriage, would it impact her PR application in any manner?

3.) She travelled to US on 2nd Feb 2020 on tourist visa just to be with her husband and to kick start new life. Although her passport has marital status as "Unmarried", she declared that she is married now to immigration authorities in US and is visiting her husband. This declaration to US Immigration at the time of entry in US can in anyway affect or help?

4.) Can her husband apply for PR as her dependant now on the basis of religious certificate which they have from India and produce legal certificate before closure of his application to save on time?

5.) Whenever he becomes eligible to apply as her dependant, whether Wife's financial status or earnings in Canada will be a consideration? What are the financial requirements for her to sponsor him as dependant?

6.) Once wife gets Canadian PR will she be eligible for fee concessions for studies in US?

7.) Basis her Canadian PR, can she apply for job in US to gain some work experience as her husband is employed in US on H1B Visa to make best use of her time and stay with her husband? Of course she will adjust the time of stay according to minimum requirement of 3 years to retain PR and apply for citizenship in Canada.

Thanks a lot.

1. Yes, she needs to update IRCC. She should have updated them way back.

2. It will impact the app in the sense that she is legally required to add her spouse.

3. No.

4. She can inform IRCC and see what they say. They will need the legal certificate for the app to be complete.

5. She wouldn't be sponsoring him. She will be adding him to her app and will need to show increased proof of funds for him.

6. Of course not. The US is a different country...

7. As above.
