Unique Conditions - Not sure if family sponsorship is the right option

Hi all,

I entered Canada few weeks ago using a visitor visa and I am going to stay for around 2 months or so. Then, I've decided to apply for the permanent residence since my wife is Canadian. I am not sure if the family sponsorship is the right option for me or not because I also want to apply for a permanent job and reside in Canada permanently. One more thing to note here is that finding a permanent job in Canada won't be my top priority until a year from now because I still need to go back to the United States and complete my Master's degree for a year.

What do you all think is the right option here for me in terms of saving time and getting my PR?

Family sponsorship is the right option for you. Once you are a permanent resident, it does not matter through which stream you have applied, you have all the same rights as every other permanent resident. Your wife can sponsor you, and if/when you are approved for PR, you'll land and be able to work and reside in Canada permanently. Being from the United States, you should apply outland. Outland applications are being processed in as little as 2 months currently, for the US. You don't have to move here right away, but you will have to land before your Confirmation of Permanent Residency expires. Generally that's when the medical expires (so one year from the date you complete your medical). "Landing" does not mean you have to move here, just report to the border and finish your landing procedures. You'll be able to travel back and forth with your COPR and passport while you await your PR card.

Thank you for your response. I am a bit confused here and have few questions. Am I gonna get the PR status once my application for the sponsorship is approved? Or is it a separate process and application that must be done after the approval of sponsorship?

Also, I am not from the United States and I need a visitor visa to enter Canada. Does this change anything you explained?

My apologies, I shouldn't have assumed where you were coming from. Generally, the process is similar to what I explained above. The Family Sponsorship application has a few stages. First, you'll submit the completed application through whatever channel you choose - inland or outland. Most offices are processing outland applications faster than the inland application processes. Also, if you opt to process inland you would have to remain in the country for the entire processing time. That is currently quoted at 26 months on the CIC website, however many applications are processed much faster than that (my own inland application processed in less than a year).

In the completed application, what you'll send to CIC, you'll include all the forms as well as a police clearance from every country you've been in for longer than 6 months since your 18th birthday. You can also choose to include your medical exam or wait for them to request it. You'll receive something called AOR, acknowledgement of receipt. This means they've opened your application and verified that everything was properly filled out and signed and then you're back in the queue for processing. You'll then receive something called AIP, approved in principal. You'll also receive SA, sponsor approval, this means that your wife was deemed eligible to sponsor you (no criminal record, not on welfare, etc). After that, you'll receive your decision and land if approved. After it's all said and done, at the end of the processing, then you'll be a permanent resident. The sponsorship and permanent residency are, essentially, the same thing. They're not separate processes. She's sponsoring you to be a permanent resident.

Sorry, I meant which office would be processing your application. Where is your home country? You can apply from physically anywhere in the world, but if you are not from the United States, your application will process in wherever your home country is :) There are threads in this subforum relating to specific Visa Offices and you'll probably find other helpful information in whichever thread is relevant to your Visa Office.
